Equal Employment Opportunities Detail Discrimination in employment matters is illegal. Discrimination occurs when members of one group (race, sex, age, etc.) are treated differently from members of other groups. If different treatment is given to an employee as an individual rather than to a group it is not discrimination, although it may involve a different compliance question, or may by an issue an employee may wish to pursue through the grievance process. Equal Employment Opportunities Question and Answer 2 Q - My supervisor (female) is always harassing me (male) about coming in late. I’m late because I have car problems. Is this covered under EEO? Whom do I call regarding this matter? A. – The first place to discuss your feeling of being harassed is normally with your supervisor. You may also address issues with higher level managers in her chain of command. This issue is not an EEO question as long as your supervisor treats all employees consistently. Inconsistent treatment, where lateness is tolerated for females but not for males may suggest an EEO question. In that case, call the Equal Opportunity/Affirmative Action/ADA Coordinator at 381-2127. Time Keeping and Overtime Extra pay for overtime is required by law (Fair Labor Standards Act) for: Clerical, secretarial, service, maintenance, technical, and paraprofessional employees required or permitted to work over 40 hours per week. How is the extra pay handled? Overtime is compensated at one and one-half times the regular pay rate. It can be paid by payroll or by compensatory time off – the University’s choice. Time Keeping and Overtime : Detail References Details Main Points Main Points Time records for employees entitled to overtime must show: All hours worked Vacation, sick or any other type of leave taken Compensatory time taken Example 1: Employee “X” worked 48 hours during the week with no vacation, sick, holiday, or other paid leave taken. Employee would receive 8 hours overtime plus 4, which is half of 8, for a total of 12 hours overtime as time and a half because the employee worked over 40 hours for the week. Example 2: Employee “X” worked on a holiday, or took vacation or sick leave day during the same workweek for a total of 40 hours. I like to get all of my work done each day, so sometimes I work extra, but I only record eight hours of work on my time report. My supervisor is okay with this-is it okay? A - No. You should accurately record, to the nearest quarter hour, all the time you work each day. When you sign your time card, you are certifying that the time recorded is accurate. If it is not accurate you have falsified an official University document and are subject to discipline. So you need to work this out with your supervisor and either get permission for working overtime you are paid for, or limit your time worked.
