Environmental Rules and Requirements TRM-FM-0038 (Annexure C of TST41-120) - Contractor Environmental Compliance is the acknowledgement form issued to the tenderer for his or her own acknowledgement of a clear understanding of all the Environmental requirements. Signing the form that is Annexure C will be deemed as your acceptance to conform to the following documentation and application of such within your scope of work. The following Policies/Procedures are in support of Environmental requirements: Eskom SHEQ Policy (EPC 32-727) TST41-120 rev 2 : Environmental Requirements for the Procurement of Assets, Goods and Services ST32-726 for additional SHE requirements These are not tender returnables the are only there for guidance and reference purposes 3

2016/06/144 TST41-120 Supplier Contract Requirements” The purpose of the Eskom Transmission Environmental Requirements for the Procurement of Assets, Goods and Services specification is to define the requirements by which Contractors and Suppliers shall manage, implement, maintain and continually improve a Environmental Management System (EMS) based on ISO 14001:2004 The intention is that Contractors and Suppliers should continuously adhere to Environmental requirements in respect of the supply of products and related services. TST41-120 Shall be implemented on all new contracts, and extensions to existing contracts.

Environmental tender evaluation criteria 1) Non- negotiable minimum requirements that tenders have to address and respond to when submitting tender returnable for evaluation are (refer to section 2 of TRM-FM0081) Project specific Environmental Management Plan (EMP) for all environmental concerns raised through the Eskom EMP and in any other relevant forum such clarification meetings. Please refer to the attached EMP and section B of TRM-FM0081(all applicable items0 2) Objective criteria Compliance to ISO 14001(refer to table below) 5

2016/06/146 Section A of TRM-FM 0081: EMS Requirements- Objective evidence of a documented EMS that is certified/ not certified ISO 14001 ClauseEvaluation Criteria/ Required Documents 4. 1Environmental Policy (SHE/SHEQ Policy) Environmental / SHE/ SHEQ Policy: The employer should develop and maintain a policy that is suitable and sufficient in order to address the environmental management needs of the company 4.3.2Environmental objectives, targets and programmes(s) Procedure : Documented environmental Environmental objectives, targets and programmes(s) 4.4.1Resources, roles, responsibility and authority Procedure: Documented roles and responsibilities for the implementation of Environmental Management System Appoint environmental representative for the project in writing 4.4.2Competence, training and awareness Procedure to ensure that any person(s) preforming task for it or on its behalf are made aware of the importance of conformance to the environmental legal and other requirements. 4.4.3CommunicationCommunication Procedure: to ensure effectively communication of environmental issues with employees and client during project 4.4.7Emergency preparedness and response Emergency preparedness - A Procedure is required from the contractors to show procedures for dealing with possible emergencies that can occur, such as vehicle spillage. The method statements must include the communication protocols to be followed, and contingencies to be put in place for the potential emergencies. Contractor must also provide procedure on how disturbed area will rehabilitated once activities have terminated or after an incident Environmental Documents required for Submission
