3 The Stats  Audit was taken 10 times by 9 firms  (1 firm took it twice)  The audit takes 1 hour (or less) to pass  ALL the firms failed  Best = 2.5 hours  Worst = 8 hours  Average pace = 5 hours

4 So, what is the Audit? “…hypothesis is that lawyers in general are woefully deficient in using the software tools at their disposal – e.g., Word, Acrobat, Excel The audit tests this by providing mock assignments. Sample tasks include: formatting a motion in Word preparing motion exhibits in PDF creating an arbitration exhibit index in Excel. The specific tasks are of little importance as they are designed to test general skills. The foregoing examples could just as easily be any of the other myriad, routine, low-value-added tasks that lawyers regularly complete on their computers (or should).

5 FACT : Many, if not most lawyers are shockingly bad at very basic skills, like making changes in Word documents, de-duplicating Excel spreadsheets, and redacting PDF files. FACT : These are skills that should be expected of every attorney. Being able to do thinks like editing your own documents in order to make them presentable and preparing documents for e-filing are legal work.

10 ″It’s not incompetence, it’s lack of training,″  Client-Lawyer Relationship Rule 1.1 Competence - Comment  [8] Maintaining Competence  To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology, engage in continuing study and education and comply with all continuing legal education requirements to which the lawyer is subject. Is it because lawyers don’t have enough time to be trained in technology, or is it because getting trained isn’t a priority ?
