Football Graduate Replacement What was the original intent behind the midyear graduate replacement exception? Encourage institutions to continue providing athletics aid to football SA’s who had graduated but still had eligibility remaining (e.g., graduated in year four of their five-year clock but had eligibility remaining during the fifth year) While the midyear replacement legislation provides flexibility in managing institutional counter limits, premise has always been that a SA has exhausted eligibility.

Football Graduate Replacement Scenario No. 1: Graduate Transfer SA graduates at midyear. SA decides to transfer to another institution using the “graduate transfer” exception which allows the SA to be immediately eligible at the next institution.

Football Graduate Replacement Question: May the SA’s original institution use a midyear graduate replacement for the spring term after the SA transfers?

Football Graduate Replacement Scenario No. 1 Continued: The SA transfers to his second institution and completes his final season of eligibility during the fall term. The SA does not return to the institution for the spring term.

Football Graduate Replacement Scenario No. 2: SA Turns Pro SA graduates at midyear during his third year of collegiate enrollment. SA declares for the NFL draft and signs a professional agent prior to the beginning of the spring term. SA has used three seasons of competition and would otherwise be eligible to compete during the subsequent academic year.

Football Graduate Replacement Scenario No. 3: Exhausts Eligibility but Continuing Student SA graduates at midyear. SA completes his final season of competition during the fall term. SA wishes to continue as a graduate student at the institution during the spring term and participate in another sport Institution wishes to continue providing financial aid to the SA during the spring term.

Football Graduate Replacement Scenario No. 3 Continued: What if SA still had seasons of competition remaining but the SA wanted to voluntarily relinquish all remaining eligibility. Could the institution still replace the SA?

Football Graduate Replacement Scenario No. 4: SA with Eligibility Remaining Does Not Enroll SA graduates at midyear and decides not to enroll during the 2017 spring term. The SA has one season of competition remaining and will enroll during the 2018 fall academic year to complete his eligibility.

Renewal of Athletics Financial Aid (Autonomy) Scenario: SA enrolled at the institution during the 2013-14 academic year and was awarded athletics aid. SA was nonrenewed for the 2014-15 academic year and did not receive athletics aid. SA was again awarded athletics aid during the 2015-16 academic year.

Renewal of Athletics Financial Aid (Autonomy) NCAA Bylaw 15.3.5.3 – A SA’s financial aid may not be cancelled after the period of the award for athletics reasons. SA may only reduce or cancel the SA’s award if the conditions of Bylaw 15.3.5.1 are met: Ineligible for Competition; Fraudulent Misrepresentation; Serious Misconduct; Voluntary Withdrawal; and Violation of Nonathletically Related Condition

Renewal of Athletics Financial Aid (Autonomy) January 8, 2016, Education Column Does the new legislation apply to a student-athlete who first enrolled in the 2014-15 academic year or earlier? Yes, but only if: One-year award – SA received athletics aid during first year of enrollment and was renewed or received athletics aid during the 2015-16 academic year. Multi-year awards – renewed during the 2015-16 academic year or thereafter.

Cost of Attendance Adjustments Scenario: Institution awards financial aid based on student- athlete’s cost-of-attendance. SA is awarded “books, room and board” for the 2016-17 academic year. SA, per institutional policy, requests an individual cost-of-attendance adjustment for the year. SA’s cost of attendance is increased by $2,000 for other expenses related to attendance at the institution.

Cost of Attendance Adjustments If a SA’s athletics aid is based on his or her cost of attendance and his or her cost of attendance is adjusted: Need to meet the obligation created by the written agreement.

Actual vs. Average Cost of Attendance Scenario: Institution awards athletics aid based on average cost-of-attendance for students on campus. SA is an “in-state” student and lives at home during the academic year. SA’s actual cost-of-attendance ($10,000) for the academic year is less than the average cost-of- attendance ($15,000) at the institution? SA was awarded $12,000 for the 2016-17 academic year based on average cost-of- attendance.

Actual vs. Average Cost of Attendance Bylaw 15.5.3.2 – Denominator based on the actual or average cost of a full grant-in-aid for all students at the institution. Bylaw 15.1 – SA may not receive institution financial aid based on athletics ability and any other financial aid that exceeds his or her cost- of-attendance. In other words, the numerator cannot exceed the SA’s actual cost of attendance.
