Proposal City is proposing to amend Chapter 15.76 Green Building and Landscaping Practices to establish mandatory green building requirements for private development projects to modify the current green building and landscaping requirements for publicly funded projects City is proposing to repeal Voluntary Green Building and Landscaping Practices in Private Development Projects Standards Policy Statement

What is Green Building? A whole-systems, environmentally sustainable approach to building, which emphasizes Energy efficiency and Water/Resource conservation Construction quality/ Building longevity Reduction of utility and maintenance costs Health of workers and residents Enhancing quality of life in our communities

Current City Green Building Ordinance Public and Public-Private Partnership building projects over $3 Million and landscapes over 5,000 sq ft Requires certification through either LEED or Green Points and Bay-Friendly landscaping for public projects Policy Statement requires private landscape projects to incorporate Bay-Friendly measures

Proposed Public Project Requirements Provision for Public Projects revised to require LEED Silver Certification and Build it Green Certification – includes public-private partnerships Exemption language added to address situations where compliance is not financially feasible and where the project has overriding community benefit subject to City Council approval

Build It Green and GreenPoint Rated Required for New Homes GreenPoint Rated: Meet pre-requisites Score minimum of 50 pts Community, Energy, IAQ/Health, Resources, Water Endorsed by Northern CA Homebuilders Association Staff will complete rating process in-house for development of one residence Mandatory consultation with staff required for remodels over 500 sq. ft

Small Commercial Green Building Checklist Non-residential new construction and remodels/ additions over 1000 sq. ft. Includes measures in five categories: Site, Water, Energy, Materials, Indoor environment No pre-requisites or minimum points Verified by City staff during plan check and building inspections Intended to not overburden business community

Next Steps September 2009 - Application to CEC November 2009 - Second Reading and Adoption of Ordinance December 2009 - File Findings with CA Building Standards Commission Effective no sooner than January 1, 2010 (Title 24)

Recommendation The Planning Commission recommends that the City Council introduce the attached Ordinance and hold a public hearing for Zoning Text Amendment, AT- 04-09, to amend Chapter 15.76, Green Building and Landscaping Practices and approve a Resolution repealing the Voluntary Green Building and Landscaping Practices in Private Development Projects Standards Policy Statement
