The History of Mental Health Partnership working April 2005 : Section 31 Partnership Agreement signed between Solihull MBC and BSMHT for integrated provision of adult mental health services – staff seconded to BSMHT, Partnership Board established, budget still held by SMBC Summer 2005 : Consultation on the formation of a Care Trust in Solihull Partnership Board suggests that staff should transfer to BSMHT not the new Care Trust Feb/March 2006 : application to the DoH to become a Care Trust, work starts to transfer staff to BSMHT

The History of Mental Health Partnership working July – Oct 2006 : BSMHT consults on being a Foundation Trust October 2006 : Care Trust established. Work to transfer staff to BSMHT not complete. Staff and budgets for adult mental health remain with SMBC – all other adult social care functions go to the new Care Trust 2007 : Care Trust establishing itself. BSMHT going through FT March 2008 : Original Section 31 agreement SMBC/BSMHT expires and extended for year. Little progress made on TUPE 31 st March 2009 : Agreement expires again

The Current Position Adult Mental Health Social Care services are: Budget : £2,081,000, inc. some commissioning : 37 staff in post 2 managers & support 13 Social Workers & 2 admin in 2 integrated Community Mental Health Teams – based at Lyndon Clinic and Newington Centre 2 SWs in Assertive Outreach team, 3 in Home Treatment, 2 in Early Intervention 13 staff in the Community Recovery Team

Need a new solution for the changed world A staff transfer does not take place in isolation – it is the function that transfers and the staff follow Adult mental health remaining with the Council is an anomaly and presents risks in terms of professional support and delivery of this statutory function The budget remaining with the Council is an anomaly and presents technical difficulties for payments, etc. The employment status of adult social care staff needs to be resolved. Social care staff need to feel supported and valued in an organisation that understands social care

The Proposal That the Adult Social Services Mental Health Function should be delegated to the Care Trust All Adult Social Care would be provided through the Care Trust All budgets, including Adult Mental Health, will be pooled Adult Mental Health aligned with the rest of adult social services and monitored through existing Partnership. Staff then transfer as the undertaking transfers to the Care Trust Staff employed by a health & social care organisation, resourced to take on this additional function

The Proposal That the Adult Social Services Mental Health Function should be delegated to the Care Trust Adult mental health social care not delegated to BSMHT in the future On expiry of the Section 31 Agreement on 31 st March 2009, the Care Trust takes on the line management of staff in the interim

The Proposal BSMHFT do not line manage, but work in partnership to deliver an integrated service Focus on outcomes for those who use the service, rather than on the employment of staff A Joint Operational Board and Partnership Protocol to manage the changed partnership and ensure that service users do not experience any changes at the frontline. Staff remain co-located and working together.

Timescales January 2009 : Cabinet Member and Care Trust Board agree to proposal in principle, subject to consultation with staff and stakeholders and further detailed work. March 2009 : Interim arrangements in situ when the existing Section 31 expires. Care Trust line manage adult social care on behalf of SMBC. July 2009 : Final decision made by Cabinet and Care Trust Board, following consultation and detailed scoping. October 2009 : Target date for transfer of staff if all issues resolved

Scrutiny Board Staff will be formally consulted on the proposal from Feb-May 2009 Proposals has been discussed with stakeholders and will be presented to the Partnership Board on 9 th March Views of the Scrutiny Board are sought on this proposal, prior to any formal decision being made in summer 2009
