GREECE’S COURT SYSTEM Judicial system of Greece : Established system of courts is contained of three branches. Civil, Penal, and Administrative Courts. o The supreme court of administrative justice is the Council of State. o Greek judges belong to one of these two branches. o The administrative judge is not entitled to judge a penal or civil case, while a civil judge is entitled to judge a civil or penal case but not an administrative one.

CIVIL JUSTICE o First instance, by the District courts, according to the estimated value of the matter disputed at law. o Second, by the Court of First Instance or the Courts of appeal, according to the estimated value of the matter disputed at law. o By the Court of Casstation, when a writ of certiorari is filed against a final decision of the Court of Appeal. o Certiorari: an order by which a higher court reviews a decision of a lower court.

PENAL JUSTICE Felonies are judged, at first instance, by the “mixed” Court of First Instance and, at second instance, by the “mixed” Court of Appeal. In these “mixed” courts participate four jurors and three professional judges( of first instance and appeal respectively). Court of Cassation examines writs against the final decisions of the Courts of Appeals and it can order the rehearing of a case by the lower court, if it concludes that the lower court violated the law or the principles of the procedure. Court of Cassation: do not re-examine the facts of a case, they are only competent for verifying the interpretation of the law. Misdemeanors are judged, at First Instance by the Misdemeanors Court.

ADMINISTRATIVE JUSTICE Overall system in which decisions of an administrative or executive nature are made in relation to particular persons.

YOU CAN BE ARRESTED IN GREECE IF: If there is a warrant against you ( which can be issued by investigating judge or public prosecutor.) If you are caught in the act. Police have the authority to arrest you, without a warrant, up to 48 hours after you have been caught in the act of committing a crime. You can be detained for an initial period up to 5 days before you are produced before a judge.

EARLY LAWS After the Dark Ages- about 1200-900 BC- the Ancient Greeks had no official laws or punishment. Murders were settled by members of the family members of the victim, who would then go kill the murderer. This then began endless blood feuds. It wasn’t till the middle of the seventh century BC that Greeks first began to establish official laws. Around 620 BC Draco, the lawgiver, wrote the first known written law of Ancient Greece. This law exile as the penalty from homicide. Solon, the next lawgiver created new laws that fit into the 4 basic categories. Tort laws: Murder, trespassing, rape, theft. Ex. Fine for rape was 100 drachmas=33 cents Family laws: Marriage, Adoption, Men & women behavior. Ex. Allowances in marriage and adoption Public laws: How public services were provided. Ex. Forbid the export or agricultural goods except olive oil, also vendors could charge any kind of interest rate they wanted. Procedural laws: Guidelines for judges. Ex. Step-by-step to teach judges how to correctly judge.

GUN LAWS IN GREECE o In 2011 the National Guard were getting disarmed in the sensitive area of Macedonia. The government bully’s hunters and those who are in the shooting sports. For Ex. The issuing of gun licenses is illegally & intentionally delayed by officers of the Greek Police. On June 3 rd, 2013: 600 illegal AK- 47’s were in circuit, without mentioning hand guns. In 1997 all weapons in the UK were destroyed, and a rise of violent crimes was observed thereafter.

DEATH PENALTY MethodYear of Use Abolished Firing Squad 1972 1975 Greece abolished the death penalty in 2004. In 2005, Greece ratified the Protocol No. 13 to the ECHR, concerning the abolition of the death penalty under all circumstances. The European Convention on Human Rights (ECHR) (formally the Convention for the Protection of Human Rights and Fundamental Freedoms) is an international treaty to protect human rights and fundamental freedoms in Europe.

DRUGS AND ALCOHOL Alcohol Age: To Drink To Purchase None 18 If caught drug trafficking that would bring profits of more than $75,000 euros ( $84.91 US dollars) are sentenced to life in prison. Meth (Shisha) is the major drugs that Greek addicts are addicted too.

WEIRD LAWS IN GREECE All electronic games are banned. It is illegal to dance naked in Acroplolis. It is illegal to strike anyone from Turkey with a phalanx (small sword) except on alternate Monday. If you moon someone in Greece it is a chargeable offense in Greece that can bring a big fine or even jail time.
