2 OBJECTIVES OF THE REFUGEE PROGRAM http://laws.justice.gc.ca/eng/acts/I-2.5/page-1.html http://laws.justice.gc.ca/eng/acts/I-2.5/page-1.html IMMIGRATION AND REFUGEE PROTECTION ACT OF 2002 1.Save lives and protection to the people who are displaced and persecuted 2.Fulfill and affirm Canada’s international commitments to protect refugees 3.Grant fair consideration to people who claim to be persecutes, as an expression of Canada’s humanitarian ideals 4.Offer refuge to people facing persecution because of race, religion, political opinion or membership in a social group, and to people who face torture, cruel or unusual punishment

5 THE SINGH DECISION Satnam Singh came to Canada from India seeking refugee status, and his case was rejected under the Immigration Act of 1976 Those rules did not allow Mr. Singh to state his case in person or appeal the government decision The Supreme Court said this violated section 7 of the Charter or Rights and Freedoms –Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice. The Supreme Court said everyone in the Charter means everyone- every person physically present in Canada

6 THE SINGH DECISION Result –People claiming refugee status have the right to a hearing which they attend in person –An Immigration and refugee Board was established to provide quick and fair hearings –The Government of Canada provides people with the necessities of life while they wait for a hearing
