Air Transport – PUBLIC ENTERPRISE AIRPORTS OF MONTENEGRO M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT POLICY 1999 – Pubilc Enterprise Airports of Montenegro constituted by the Government of Montenegro. 2003 – Public Enterprise Airports of Montenegro took over Podgorica and Tivat Airport from their former owner Jat Airways, after that two airports undergone very complex and broad scope program of modernisation and reconstruction. 2006 – Completed projects for modernisation and reconstruction of Podgorica and Tivat Airports significantly enhanced capacities of both airports, provided infrastructure and other relevant prerequsites required to respond to the demands of potential users at the time and in the close future, along with increased levels of security, safety and handling of aircrafts, passengers, baggage, cargo and mail. 2007 – Podgorica Airport won ACI Europe Award for the best airport under 1 million passengers, based on its remarkable evolution from a non-existing infrastructure to an airport that can compete with international airports. 2011 – Public Enterprise Airports of Montenegro winner Regional Business Partner Award.

In next few months, 2013 – Public Enterprise Airports of Montenegro will be restructured into a Joint-stock company.

M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union On January 10 2011 Montenegro adoped the Law on Amendments to the Law on ratification of the Multilateral Agreement between the European Community and its Member States, the Republic of Albania, Bosnia and Herzegovina, the Republic of Bulgaria, the Republic of Croatia, the former Yugoslav Republic of Macedonia, the Republic of Iceland, Montenegro, the Kingdom of Norway, Romania, the Republic of Serbia and the United Nations Interim Administration Mission in Kosovo on the establishment of a European Common Aviation Area (ECAA) and adopted the Council Regulation (EEC) No 95/93 of 18 January 1993 on common rules for the allocation of slots at Community airports, with the following amendmnets: Regulation (EC) No 894/2002 of the European Parliament and of the Council of 27 May 2002; Regulation (EC) No 1554/2003 of the European Parliament and of the Council of 22 July 2003; Regulation (EC) No 793/2004 of the European Parliament and of the Council of 21 April 2004; Regulation (EC) No 545/2009 of the European Parliament and of the Council of 18 June 2009; Air Transport – SLOTS Chapter 14: TRANSPORT POLICY

M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Air Transport – SLOTS Chapter 14: TRANSPORT POLICY In conformity with the Law on Air Transport of Montenegro (2012), Article 52, Paragraph 2, the way of expanding or limiting airport capacity, schedule facilitation and slot alocation shall be governed by a regulation to be laid by Civil Aviation Authorities of Montenegro. The regulation is planned to be adopted in the forthcoming period. Based on the previous demand of the aiport users, it was not necessary for Podgorica and Tivat Airport to be open for 24 hours. In conformity with the Law on Air Transport, Article 55, Paragraph 4, the airport operating hours shall be defined by the Ministry of Transport and Maritime Affairs upon proposal of the Airport Operator. Podgorica and Tivat airport define airport operating hours for winter and summer season based on the schedules provided by the airport users. Tivat Airport is restricted to daylight operations, while Podgorica Airport, upon request of airport user, issues approval for landing and take-off out of the operating hours, on non-discriminatory basis, in all as for the Paragraph 2, Article 55 of the Law on Air Transport. Podgorica Airport records even traffic volume throughout whole year, with slight growth of charter traffic in summer season, while seasonality is distinctive in traffic at Tivat Airport, with significantly higher traffic volumes in summer compared to winter season.

Capacity of Tivat Airport (ICAO - LYTV, IATA – TIV): 2500m x 45m Runway 14/32; 2 taxiways; 7 aircraft stands (5 for Code C aircraft + 2 for Code D aircraft); 12 aircraft stands for general aviation aircrafts (wingspan ≤20m); 4050 m² passenger terminal; 12 check-in counters; 6 gates; 2 baggage claim carousels.

M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Air Transport – SLOTS Chapter 14: TRANSPORT POLICY Master Plan of Airports in Montenegro by 2023 was prepared in 2003 by Barents group. Review and update of the 2003 Master Plan was done in 2011 by Halcrow Group Ltd covering the period by 2030. Based on the traffic growth forecast, the reviewed Master Plan provides for infrastructure investments aimed at enhancement of the existing capacities of both airports, with a special emphasis being placed on Tivat Airport.

M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Air Transport – SLOTS Chapter 14: TRANSPORT POLICY Considering the traffic volume at Tivat Airport has exceeded the high-case forecasts provided for in 2003 Master Plan, there is a need for construction of a new passenger terminal and the pertaining infrastructure in order to maintain the acceptable service level and avoid any potential saturation at the airport in the future. Additionally, based on the forecasts implying increase in number of operations, and also in order to comply with the standards defined by national and international regulations, there is a need for reconstruction, expansion and modernization of the maneuvering areas at both airports. With the 2011 Master Plan and the State Study of Location for Tivat Airport adopted, the grounds have been formed for implementation of new development projects at both airports. Therefore, Public Enterprise Airports of Montenegro is highly committed to preparations for implementation of the identified priority projects, with the ongoing activities being the following: Preliminary Design for New Passenger Terminal at Tivat Airport, inclusive of apron extension, and Final Design for Reconstruction, Expansion and Modernization of Maneuvering Areas at Podgorica and Tivat Airports.

M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Air Transport – SLOTS Chapter 14: TRANSPORT POLICY Three strategic documents for development of Public Enterprise Airports of Montenegro and air transport in Montenegro – 2003 Master Plan by 2023, 2011 Reviewed Master Plan by 2030 and State Study of Location for Tivat Airport – contain analysis of present and future demand with a view to the infrastructural capacities, hence there has been no need for any other analysis of the available capacities at either airport. Furthermore, airport operators as a part of internal analysis re-analyze their capacities before each season based on the notified schedules. From the aspect of the traffic volume, present capacities at both airports meet demands of all airport users and so far there has been no need to define either airport as schedule-regulated or coordinated airport. This is further confirmed by the fact that none of the airport users has ever raised an issue in this regard. At Podgorica and Tivat Airports, schedule and charter airlines provide their flight schedules before each summer and winter season in a form of a proposal, based on which the airport operator issues approval, forms airport flight timetable, with good organization deploys all the available capacities to the maximum extent and accepts each interested airline fairly and without discrimination.
