Grassland/Meadowgreen Sewer Project Assessment and Non-Payment Policy and Procedure

Assessment Initiation Following completion of the sewer project: written notice of ability to connect will be sent to the property owners along with notice of the Final Assessment Resolution The Final Assessment Resolution will be considered by the County Commission

Payment of Assessment Following passage of the Final Assessment Resolution: The property owners will be given Notice of the Assessment and will have 60 days to pay the lump sum payment with no interest directly to the County. If the property owner chooses not to pay lump sum, the County will assume that the property owner wishes to utilize the 20 year repayment option and consider the Assessment an Assessment Loan.

Assessment Loan The County has always maintained that property owners have the option of paying the Assessment over a 20 year period in monthly installments. If after 60 days payment is not received, the County will forward the list of properties to the City of Franklin to begin billing the Assessment on a monthly basis along with the water bill. In the case of property owners who are not residents, the Assessment bill will be sent to the property owners and not the residents.

Assessment Loan The Assessment Loan: is subject to interest may be paid in full at any time without pre- payment penalty transfers with the property (but it is advisable to extinguish the Loan upon property transfer)

Delinquent Payments In the event the Assessment Payment is not received by the City of Franklin, the County will be given notice every 30 days The County will take action to notify the property owner of the delinquency and follow its Non-Payment Policy

Non-Payment Policy In the event of Non-Payment of the Assessment: 30 day Certified Notice will be sent to the property owner If not cured, 60 day Certified Notice will be sent to the property owner If not cured, 90 day Certified Notice will be sent to the property owner

Non-Payment Policy In the event the delinquency is not cured following the 90 day notice: A Lien will be placed on the property and filed with the Register of Deeds office for the full amount of the Assessment.
