March 2012 Private Schools and ESEA ESEA (Sections 1120 and 9501) requires that access to equitable services be offered to: Eligible students Their parents (Title I applicable) Teachers Other educational personnel Services are to be of assistance to those above No funds go directly to private schools or general needs of private school Participation by private schools not required 2

March 2012 Location of Language in ESEA Regarding Private Schools 3 Title I, Part A, (Section 1120) has its own provisions governing private school participation. The Uniform Provisions in Title IX, Part E, Subpart 1, of ESEA govern the participation of private school students in certain programs.

March 2012 Requirements for Timely and Meaningful Consultation Consultation occurs between public and private school officials for the purpose of: designing and implementing a program that will provide equitable services; and meeting the needs of eligible private school students, teachers, and other education personnel. Consultation must: occur before any decision is made that could affect the ability of private school students, teachers, and other education personnel to receive benefits; and continue throughout the implementation and evaluation of services. 8

March 2012 Consultation Process 10 For competitive grants, consultation should take place during the development of the grant application. Offering services without an opportunity for timely and meaningful consultation does not meet the requirement of the law.

March 2012 Equitable Participation Divisions are required to provide services to eligible private school students, teachers, and other personnel consistent with the number of eligible students enrolled in private elementary and secondary schools in the school division, or in the geographic area served by another entity receiving federal financial assistance. March 2012 Student, Teacher, and Principal Eligibility 18 Private school students, teachers, and principals in nonprofit private elementary and secondary schools, including religiously affiliated schools, are eligible under the same conditions as the federal program allows for public school students, teachers, and principals.

March 2012 Bypass and Title I, Part A 21 Bypass is a means by which USED directly provides Title I, Part A, equitable services to private school students and teachers through a third-party provider. (Section 1120(e)(1-3)) Virginia is a Bypass state. Services are offered by a third party provider to private schools in 14 school divisions. All other eligible private school students in the remaining 118 school divisions must receive Title I, Part A, services through their resident public school division.

March 2012 Consultation Process 24 Consultation with private schools is the responsibility of the school division. The division is responsible for providing equitable services for its eligible children who attend private schools, even those attending private schools located in other divisions.

March 2012 Requirements for Timely and Meaningful Consultation Consultation occurs between public and private school officials for the purpose of: designing and implementing a program that will provide equitable services; and meeting the needs of eligible private school students, teachers, and other education personnel. Consultation must: occur before any decision is made that could affect the ability of private school students, teachers, and other education personnel to receive benefits; continue throughout the implementation and evaluation of services; include discussing funds reserved at the division level, if applicable, for professional development, parental involvement, and special divisionwide instructional programs; and result in a written annual affirmation of consultation signed by an official of each participating private school (Section 1120) Specific to Title I 25

March 2012 ESEA Flexibility 31 The U.S. Department of Education has invited all states to apply for a flexibility waiver from certain federal accountability requirements under the Elementary and Secondary Education Act of 1965 (ESEA), as amended by the No Child Left Behind Act of 2001 (NCLB). March 2012 ESEA Flexibility, Title IX, and Equitable Services 33 Do the ESEA waivers allow school divisions to waive the Title IX equitable services provisions? No. Under ESEA Section 9401(c)(5), the Secretary may not waive any statutory or regulatory requirements related to the equitable participation of private school students, teachers, and families. If a division transfers funds out of Title II, Part A, how does this impact equitable services to private schools? A school division may transfer up to 100 percent of its funds out of Title II, Part A, into another allowable program. However, it must: 1) engage in meaningful consultation with private schools prior to making this decision; and 2) set aside and provide equitable services to private schools at least to the level assured through hold-harmless provisions. Once funds are transferred to another program, equitable services must be provided according to the provisions under that program as well.

March 2012 ESEA Flexibility, Title I, and Equitable Services 34 Do the ESEA waivers allow school divisions to waive the Title I equitable services provisions? No. Under ESEA Section 9401(c)(5), the Secretary may not waive any statutory or regulatory requirement related to the equitable participation of private school students, teachers, and families. Must a division consult with private school officials prior to deciding how to use Title I, Part A, funds that may be freed up if the division is no longer required to meet requirements related to improvement? Expenditures allowed throughout the school year If private schools have not been given the opportunity to start their services at the same time as the public school, the school division should provide additional time for private schools to participate in equitable services. March 2012 Transportation for Private School Students Section 22.1-176.1 of the Code of Virginia 38 Local school boards may enter into agreements with private schools within the school division to provide student transportation under terms that local school boards deem appropriate. Terms may include arrangements relating to cost-sharing, fees, insurance, and liability.

March 2012 Effective Communication Between School Divisions and Private Schools 41 Designate a contact person at the school division and private school to ensure effective and open lines of communication. Work together to determine a timeframe for implementation of services. Division: Requests information from private schools within a reasonable time frame. Private Schools: Submit reports and respond to inquiries from the school division in a timely manner.
