3 What is the UC Technology Accelerator for Commercialization? The UC designated office with the authority to represent UC inventions/IP Formerly known as the Intellectual Property or Technology Transfer Office Represents UCs new model in which commercialization is the intended outcome and IP protection and technology transfer are supporting functions

More accurate reflection of growing expectations of research universities and role in economic impact Legal obligation to Federal and State Government to produce outcomes based on funded research Ability of university research programs to create base for new products and entirely new industry clusters 4

11 Starting Point - Invention Disclosure Per State of Ohio Law: Ohio universities own discoveries, inventions, or patents that result from university research or investigation. Generally applies to all employees, students, and volunteers, depending on scope of employment and use of resources. However… 11

12 …UC and Inventors Share in Proceeds UC policies exist for distribution of proceeds from out-licensed IP to reward the inventors for their contributions Income total from all licensee payment forms (e.g. fees, milestones, royalties) 12

14 Understanding Intellectual Property Protection Patents – Useful, Novel, Non-Obvious Tangible Research Materials – Valuable, Complicated to Produce Copyrights – Software, Creative Works Trade Secrets – Processes Trademarks 14

15 Rights and Duration of Different IP Gives you the right to exclude others –Trade Secret –> unfair use –Trademarks –> confusion or dilution –Copyright –> unfair use or copying –Patents –> making, selling, offering for sale, importing For a length of time –Trade Secret –> as long as it’s a secret –Trademarks –> as long as it is used in commerce –Copyright –> life of the author + 70 –Patents –> 20 years from filing 15

16 A Note of Caution: Preventable Barrier to Commercialization in Universities Issue: Presenting or publishing an invention publicly prior to the filing of a (provisional) patent application with a patent-granting agency. Consequence: Destroys international filing eligibility, and perhaps US filing too, by becoming “prior art” in respect to novelty requirements 16

17 UCTAC: Commercialization Pathway Through Existing Company Licensing Not Everything is a Start-up What is involved: Licensing is analogous to renting –A license agreement is in its simplest form a rental of IP to a licensee –Universities generally don’t sell IP. They lease it.
