1 WASTE BATTERIES AND ACCUMULATORS REGULATIONS 2009

2 Batteries Regulations - Aims Those that import or manufacture batteries or products with batteries, pay for the cost of collecting and recycling waste batteries. Reducing and in places removing waste batteries from Landfill or Incineration. Increasing recycling of waste batteries (substantially for the UK).

3 What is a Battery or Accumulator A battery or accumulator is considered to be any source of electrical energy generated by direct conversion of chemical energy and consisting either: One or more primary battery cells (non-rechargeable or disposable batteries); or One or more secondary battery cells (accumulators or rechargeable batteries). Battery A Battery is non-rechargeable. Accumulator An Accumulator is rechargeable.

4 Battery Pack Battery Pack A Battery Pack means any set of batteries or accumulators that are connected together, or encapsulated within an outer casing so as to form a complete unit, that the end user is not intended to split up or open.

6 Portable Batteries  Sealed  Can be carried by an average person without difficulty  Capable of being used in a consumer household product  Is not an automotive or exclusively industrial battery Typically includes:  Standard ‘AA’, ‘AAA’, C & D batteries;  Button cell batteries

7 Portable Battery Compliance There are two categories of business that Portable Battery Compliance affects:  The ‘Producer’  The ‘Distributor’

8 Portable Battery Producer Any person/company that, irrespective of selling techniques used, including by means of distance communication: Places portable batteries on the market for the first time in the UK

9 Types of Portable Battery Producers SMALL Less than one tonne of batteries put to market in a year No need to join a Compliance Scheme Must pay £30 to the Environment Agency by 15 October each year Must provide data on an annual basis of weight of batteries put to market

10 Types of Portable Battery Producers LARGE More than one tonne of batteries put to market in a year MUSTMUST join a Compliance Scheme Must Register by 15 October each year Must provide data on a quarterly basis of weight of batteries put to market

11 Portable Batteries Collection Rates The UK is currently collecting and recycling 2.5% of portable batteries in 2009. Collections rates required: YearTargets 201010% 201118% 201225% 201330% 201435% 201540% 2016 onwards45%

12 How to avoid the High Cost of Portable Batteries Compliance Avoid being a Portable Battery Producer: Do not Import batteries in your products Purchase UK batteries Buy your products in the UK Give vouchers for batteries with your products COST COST COST

13 How to avoid the High Cost of Portable Batteries Compliance If you cannot avoid Batteries can you keep yourself below the one tonne Import less than one tonne of batteries Import only rechargeable batteries (accumulators) Import extra batteries in 2009 Review your product range to assess the profitability against being below the one tonne of batteries

14 Data Reporting Data required as follows: Annual for small portable, industrial and automotive. Quarterly for large portable. LEAD ACIDLEAD ACID NICKEL CADMIUMNICKEL CADMIUM OTHEROTHER

15 Current Status on Portable Battery Producer Compliance Weee Link members contacted to provide tonnage information 7 Battery Compliance Schemes approved Potential Battery Compliance Schemes contacted in confidence to provide costs Weee Link secured 20 tonnes of portable batteries.

16 Recommendations for Large Portable Battery Producers ERP are competitive in price and have the backing of global electronic companies ERP’s £1,500 fixed price. Members importing 1 to 5 tonnes of portable batteries p.a. should take ERP’s £1,500 fixed price. Members over 5 tonnes of portable batteries should contact us for the comparison sheet.

17 Portable Battery Distributor A Portable Battery Distributor sells more than 32 KG a year of replacement Batteries to an end user. This is exclusive of the batteries sold within products.

18 Portable Battery Distributor Responsibilities Take-back of all types of portable batteries - ‘free-of charge’ from the 1 st February 2010 Must provide information at the sales points about arrangements for taking back waste batteries Must not show the cost involved Distance sellers ( mail order/internet) must comply with the above Batteries will be collected from distributors by a BCS ‘free of charge’

19 Industrial Batteries  Designed exclusively for industrial or professional uses  Is not capable of being used in a consumer household product

20 Industrial Battery Producer Any person/company that, irrespective of selling techniques used, including by means of distance communication: Places industrial batteries on the market for the first time in the UK There is no industrial battery distributor responsibility under the Regulations

21 Industrial Battery Producer Registration If no Portable Batteries BISRegister direct with BIS by the 16 October 2009 (no charge) If Portable Batteries below one tonne Environment AgencyRegister Portable and Industrial batteries with the Environment Agency (cost £30) If Portable Batteries above one tonne Battery Compliance SchemeRegister with a Battery Compliance Scheme (cost ??)

22 Industrial Battery Producers Responsibilities for Take-Back Take-Back 1.‘Free of charge take-back’ of waste industrial batteries from your end user. 2.‘Free of charge take-back’ of any batteries with same chemistry from any end user, when original supplier has gone out of business. 3.‘Free of charge take-back’ of any industrial battery of a chemistry no longer supplied by any end user.

23 Industrial Battery Producers other Responsibilities take- backPublish, before 1 st December of each year starting 2009, details how an end user may request take- back. Declare their ‘Battery Registration Number’ when supplying to customers. Ensure waste industrial batteries taken back are delivered to an approved battery treatment facility. Ensure no waste batteries are disposed of in Landfill or by Incineration. BISReport to BIS annually by 31 st March placed on the market tonnage and has collected and recycled.
