6 What are the systems currently available to the applicants to protect their trade marks in Europe? National Trade Mark International Trade Mark (IR) Community Trade Mark (CTM) or a combination of these systems

11 The International Option : Dependent on basic application –Central attack (only around 100 cases in total) –Scope of protection dictated by goods/services of basic application the Owner must be entitled according to Madrid Protocol No professional representative required to file but could be needed during examination process in each designated country

12 The International Option : Administrative centralization of formalities by the International Bureau (one language, translation done by WIPO, renewal and post- registration records centralized (except in some countries for licenses)) Examination process within 18 months (but opposition may be longer) Refusal in individual countries does not affect registration (but examination based on different TM legal systems) Change of the trade mark not available

13 The International Option : The International system is very often used : –when the applicant is interested in countries that are not members of the EU –more cost efficient when the applicant is only interested in a few countries within the EU + Switzerland and expansion to other EU countries is highly unlikely

15 The Community Trade Mark (CTM) option: Accessible to all: Any person or business entity may apply for a CTM. But for non European applicants, one European representative must be appointed the appointed representative can be a OHIM professional representative or legal practitioner

16 The Community Trade Mark (CTM) option: Reduced administrative constraints: - one office : the OHIM - one single application and legal system - one single fee system and attractive fees (one part payable at application 975€ and the second part has to be paid only if CTM registered 1100€ - one single language (one of the 20 EU languages + designation of one of the 5 OHIM languages for communication purpose)

17 The Community Trade Mark (CTM) option: Incorporation of prior trade mark by claiming seniority Ü consequences: more effective management of TM Portofolio because - prior date of national registration is conserved - the national or international registration does not need to be renewed

18 The Community Trade Mark (CTM) option: Easy registration : broad concept of the goods and services (acceptance of class headings) Wide notion of what can be a CTM (Word, Figurative, 3D, names, other types) Effective protection : Throughout all member states Cost effective prosecution (no need to prosecute those who infringe in each Member State + CTM courts)

21 Flexibility of the CTM system : link between Madrid Protocol and CTM As from 1 st of October 2004 two new options: CTM can be a basis for International Application EC could be designated in International Application

22 Extend your CTM protection to the world - International Applications based on a CTM – The OHIM may receive IA (in any of the 20 official languages of the EU), translate when necessary, certify and transmit them to WIPO within 2 months. – only for CTM applicants or owners domiciled or having effective establishment within the EC – OHIM must notify to the International bureau any relevant changes affecting the basic CTM during the dependency period (5 years following the date of the International Application). – Transmittal fee of 300€ charged covering all other successive procedures

23 WIPO notifies the International registrations designating the EC to the OHIM Indirect CTM applications are examined in the same way as direct CTM applications. Obtain CTM protection though International Registrations Incoming International Applications designating the EC

24 Following such an examination, the OHIM will notify to the IB a provisional refusal of protection within 18 months. It could be either ex officio (absolute grounds) or based on an opposition (relative grounds). The provisional statement will have then to be confirmed or withdrawn once all procedures will have been completed (no time limit). Obtain CTM protection though International Registrations Incoming International Applications designating the EC

35 Madrid Agreement & Protocol Dependency - Central attack : … so if you attack successfully the basic reg’n ie have it struck off completely this is what happens to An Agreement IR : it ‘dies’ in all designated countries A Protocol IR : will likewise ‘die’ in all designated countries unless the owner asks for transformation ie conversion keeping the priority date but having to go through the process of a national trademark application
