Main instruments in promoting CHP (1) 1.1 Legal framework Existing energy or electricity laws in all the countries Regulations for calculating tariffs and prices for electricity and heat produced in CHP in Bulgaria, Latvia, Lithuania and Romania Ordinance for establishing the electricity produced in cogeneration in Bulgaria Regulation for qualifying the priority electricity from RES and cogeneration in Romania No secondary legislation in Bosnia & Herzegovina ANRE

1. Main instruments in promoting CHP (2) 1.2 Main conditions of legislation regarding CHP Bosnia & Herzegovina: A CHP plant, under specific regulated conditions, may become an eligible producer. Latvia: The system operator is obliged to purchase electricity produced in CHP which has efficiency higher than 80 % and provides to the centralized heating system at least 75 % of the heat produced in cogeneration. Romania: The draft of the new Energy Law contains provisions regarding promoting high-efficiency cogeneration, accordingly to the Directive 2004/8/EC ANRE

Main instruments in promoting CHP (3) 1.3 CHP support schemes (1) Bulgaria: It is sold at negotiated prices, but not less than a minimum established value, electricity from: new high cogeneration plants (becoming operational after 31.12.2003 and having guarantees of origin accordingly to the criteria set out in Directive 2004/8/EC) CHP plants becoming operational before 31.12.2003, which has this support till 31.12.2009 The system will be changed during 2005, a special ordinance for promoting a system with green certificates being drafted ANRE
