Little Johnny Little Johnny sneaks into the school’s computer lab and uses a computer without anyone knowing. He is able to access some pornographic pictures which he prints copies to show his friends. CIPA is violated because the school is failing in protecting the students from harmful material. Is the school even filtering ? AUP is violated by LJ.

Little Johnny Miss Smith, a very good teacher, clicks on a website that is in one of her e-mails. It redirects her to a pornographic website. Her computer is connected to her Smartboard. Little Johnny is sitting at his desk and sees the pictures. CIPA is violated because the school is failing in protecting the students from harmful material. Is the school even filtering? AUP is not violated unless Miss Smith knew the website was pornographic.

Little Johnny Little Johnny is issued a school laptop or Kindle to take home. At home he has access to the internet via his family’s wireless router. He accesses the internet and downloads pornographic pictures to the school’s device. He then takes the device to school and shows the pictures to his friends. CIPA has been violated because the school provided the device that allowed LJ to access harmful material. But then again, CIPA was not violated because the school did not provide the internet access that was used to access the harmful material. LJ has violated the school’s AUP.

Little Johnny Little Johnny is issued a school laptop or Kindle to take home. The school-provided device has school provided internet access bundled in the device. He accesses the internet and downloads pornographic pictures to the school’s device. He then takes the device to school and shows his friends. CIPA has been violated because the school provided the resources that allowed LJ to access harmful material. LJ has violated the school’s AUP.

Little Johnny Little Johnny takes his dad’s laptop to school. The laptop has wireless capabilities that gives him access to the school’s Internet. While sitting in the school’s cafeteria Little Johnnie brings up pornographic pictures stored on the laptop’s hard drive that he shows to his fiends. No CIPA violation because none of the school’s resources were used in obtaining the harmful material. It could be questioned that LJ even violated the AUP because he was using a privately owned device that he brought from home. What if he brought Playboy or other pictures? Would that be an AUP violation?

Common Theme? In almost all cases, the district will be held responsible (deserved or not) Protection in three ways 1. Updated Filtering on the school’s network 2. Updated Filtering on any device that a student or teacher may have access to (School laptops, Kindles) 3. Acceptable Use Policy signed by students, teachers, and parents
