Where a tree is hazardous because of decay or structural weakness and shows external signs of being in such a condition, the occupier of the land on which it stands can be held liable under the law for any personal injury or other damage it causes by breaking or falling. Hazard: Trees

Saint Lucia Criminal Code Statutory Rule and Orders, 1978, No. 10 Public Health (Nuisances) Regulations S3 and S4 Electricity Supply Act No 10 of 1999 S13. (3 ) NEMO does not cut trees. However dependant on the scenario these Agencies can help.

Saint Lucia Constitution - 1978 CHAPTER I PROTECTION OF FUNDAMENTAL RIGHTS AND FREEDOMS 1.- Whereas every person in Saint Lucia is entitled to the fundamental rights and freedoms, that is to say, the right, whatever his race, place of origin, political opinions, colour, creed or sex, but subject to respect for the rights and freedoms of others and for the public interest, to each and all of the following, namely- Preparing for Trees

Saint Lucia Criminal Code Sections 480 and 481 Notice to abate nuisance due to animal, plant or thing. 480. (2) Where any plant overhangs any premises, the owner of such premises, may, by notice in writing to the owner of the premises on which such plant is, require him or her to cut down such plant, or part thereof. Saint Lucia Criminal Code Sections 480 and 481 Proceedings and order and penalty 481. - (1) If any notice given under section 480 is not complied with, within five days after it has been given, an aggrieved person may lodge a complaint before a Magistrate, who shall investigate the complaint and make such order as he or she sees fit. (2) Where a person named in such order, fails to comply with the order within the time specified in the order the person is guilt of an offence and liable on summary conviction to a fine of five hundred dollars for every week that the offence continues. Statutory Rule and Orders, 1978, No. 10 Public Health (Nuisances) Regulations. S. 3. Nuisances. For the purpose of theses Regulations, the following shall be nuisances: (viii) any tree or other erection which interferes with the entrance of sunlight into or with free ventilation of any neighboring premises or building which is dangerous to public health and safety; Preparing for Trees

S. 4. Abatement. (1) The Medical Officer (Health) or Public Health Inspector on becoming aware of a nuisance shall serve on the person committing or permitting same, or upon the owner or occupier of the premises or in respect of which the nuisance exists or is liable to occur, a notice to abate or prevent the same within a specified time and, in addition, to do such things as may be necessary for that purpose. S4. (2) If for any reason the notice to in paragraph (1) of this section be not complied with and in addition to any proceedings which may be instituted against the person liable to conviction, the Medical Officer (Health) or Public Health Inspector shall report the matter to the Public Health Board. The Board shall cause the nuisance to be abated or prevented and may for this purpose authorise any person to enter the premises and do such things as may be necessary. Preparing for Trees

5. Expenses in connection with abatement. All expenses incurred by the Medical Officer (Health) in abating or preventing a nuisance may be recovered by the Board from the person by whose act the nuisance was caused or from the owner or occupier of the premises in which the nuisance existed. Environmental Health [Public Nuisance] The addressing of Public Health issues as it pertains to the interference with the entrance of sunlight into or with free ventilation of any neighboring premises or building. Preparing for Trees

Magistrate [Private Nuisance] The determination as to validity of the case of a Nuisance between two private entities. Preparing for Trees

Electricity Supply Act No 10 of 1999 S13. (3) where any condition exists which is dangerous or is interrupting or threatens to interrupt the supply of electricity or any part thereof, the Company may immediately enter upon any private land without consent of the owner or occupier thereof and take whatever action is necessary to establish safe conditions or to ensure the continuity of t he supply of electricity. Electricity Supply Act No 10 of 1999 S17. … whenever the Company is requested by any owner of land to do so may fell, lop or trim any tree on such owner’s land which is threatening to damage any such electric line or other works or apparatus. Preparing for Trees
