WHAT IS A LEARNERSHIP AGREEMENT ? Means a learnership agreement contemplated in section 17(1) of the act. 3

PARTIES TO THE LEARNERSHIP AGREEMENT The primary parties to the learnership agreement are the employer, training provider and the learner. The secondary party is CHIETA for contract/ agreement administrative process 4

EMPLOYMENT CONTRACT is a kind of contract used in labour law to attribute rights and responsibilities between parties to a bargain. The contract is between an “learner" and an "employer". 5

ENTRY REQUIREMENTS ( TTR 2014 ) N2 Certificate including four relevant subjects of maths, engineering science and fourth subject as required by the trade Technical trade theory programs quality assured by a SETA deemed to be equivalent to NQF 3 Relevant Engineering NCV certificate with seven subjects at NQF 3 6

ENTRY REQUIREMENTS ( TTR 2014 ) Technical Grade 11 WITH Maths, Science, Language and related trade theory subject Relevant (directly related to the trade theory subjects)N6 certificate or National Technical Diploma ( T, S or N stream) 7

DISCIPLINARY PROCEDURE Disciplinary procedures - company policy and procedures CHIETA to be informed on a suspension of an apprentice in order to extend the relevant contract Request for cancellation to be submitted to CHIETA for authorization CHIETA - investigation Learner may only leave on approval of cancellation from CHIETA 8

TERMINATING LEARNERSHIP AGREEMENT The employer and learner have agreed in writing to terminate have agreed in writing to terminate the agreement. The employer or learner has requested on good cause to terminate the agreement and other parties to the learnership agreement have had the opportunity to make representations as to why the agreement should not be terminated. The training provider has requested on good cause to terminate the agreement and other parties to the agreement have had the opportunity to make representations. 9

APPEALS Appeals to be adhered to according to organisation appeal policy. CHIETA to be approached having exhausted all organisational appeal procedures 10

TRANSFER OF LEARNERS Prospective company MUST be workplace approved Application for transfer must be completed. All parties must be in agreement to the transfer. Transfer must be tabled and approved by TFAC. CHIETA registers agreement & informs parties accordingly Learner to move to new employer on notification of CHIETA. 11

Stipends are calculated in terms of the Sectoral Determination for Learning Programme Agreements. Workplaces may “top-up” the stipend during workplace experience – but is not required. 12 STIPENDS

APPEAL TO STAKEHOLDERS: If you need INDUCTION support at your organization please submit a request to the CHIETA, advising them on where and when your training intervention is starting. The CHIETA will then contact you to determine the suitable date and we will come and present Induction. 13

THE INTERIM WORKPACE APPROVAL Aim and Applicability: Supporting of grants funded programmes on CHIETA DG Platform. Not an automatic approval as initial “walk about “visits may be done where necessary at the discretion of the CHIETA. Duration of Interim Approval: 1 Year Support to be provided by the CHIETA for Workplace to achieve full approval : A dedicated evaluator will be assigned to the Workplace to practical support and assist in the following: Provide explanation and guidance on what workplace approval is about and how to implement its process. Assist in completion of the application form Assist in gathering relevant evidence required to support application form 21

THE INTERIM WORKPACE APPROVAL(Cont.) Do a pre-site audit in order to determine its potential and capability Provide assistance in identifying and determining qualifying mentors. Provide support and guidance in situations relating to workplace not covering the full scope. Assist workplace in sourcing partnerships with secondary employers to assist in closing identified gaps. IMPORTANT TO NOTE: The support and capacity building process is at no cost to the workplace. A request to be submitted to the CHIETA is support is needed. 22

REGISTRATION OF MENTORS IMPORTANT TO NOTE: How to register?: Application forms part of the initial workplace approval application Registration will be done once the site approval has been officially approved by the CHIETA Future plans: NAMB will do the registration for national recognition of mentors. Impact on: Workplace Approval: The workplace will not be approved to host learners for experiential training Learner Registration: The learner will not be enrolled if a qualifying mentor has not been submitted Criteria to qualify as a Mentor: Section 9 Workplace Approval Policy: “ A qualified artisan in the applicable trade with a minimum of 3 years trade related experience will be deemed to be a workplace mentor…” 24
