New Statutes The following summary includes only those new statutes of immediate interest to street level law enforcement officers. Additional statutes of interest to law enforcement and telecommunications agencies are located on the DOCJT website as indicated at end of this presentation. RCT 2016-33

EFFECTIVE DATE Unless otherwise noted on individual statutes, the effective date of legislation passed by the 2016 General Assembly is JULY 15, 2016 RCT 2016-34

SB 16 Safety of Minors EMERGENCY Allows a citizen to break into a vehicle, and have immunity, if the conditions in the statute are met. “Look Before You Lock” EMERGENCY EFFECTIVE IMMEDIATELY RCT 2016-35

SB 40 Juvenile Proceedings Pilot project to open up juveniles proceedings to the public in some cases. RCT 2016-36

SB 54 Drop Off Boxes Requires identifying signage for drop off boxes that do not qualify as non-profits. RCT 2016-37

SB 56 DUI EMERGENCY. Changes the look back period for multiple DUI offenses to TEN years. RCT 2016-38 EMERGENCY EFFECTIVE IMMEDIATELY

SB 60 Vulnerable Victims Provides protection in situations of continuing conduct against a vulnerable individuals (such as a child, intellectually disabled or elderly person) RCT 2016-39

SB 63 Sexual Assault EMERGENCY. Requires submission of all sexual assault kits to KSP crime lab Requires development of policies on handling of kits EMERGENCY EFFECTIVE IMMEDIATELY RCT 2016-310

SB 84 Traffic – Stopped Vehicles Allows vehicles to stop briefly to collect trash and use the Adopt-a-Highway Program. RCT 2016-311

SB 203 Death Benefits EMERGENCY EMERGENCY EFFECTIVE IMMEDIATELY. Modifies provisions of death benefits in a LODD to continue to qualified responder’s family members during the application process. RCT 2016-312

SB 206 Reemployment of Retired Officers Allows a city police agency to rehire a retired police officer. RCT 2016-313

SB 228 Schools Defines the term “bullying” for school purposes. RCT 2016-314

SCR 9 Breastfeeding Encourages an understanding of the importance of breastfeeding. (See KRS 211.755) RCT 2016-315

HB 4 Synthetic Drugs EMERGENCY Raises the penalty level for Possession and Trafficking in Synthetic Drugs up one level. Raises Hydrocodone combination products to Schedule II. Adds W-15 / W-18 to Schedule I. RCT 2016-316 EMERGENCY EFFECTIVE IMMEDIATELY.

HB 40 Felony Expungement Allows for certain felony offenses to be, after five years, vacated and expunged. RCT 2016-317

HB 124 Body-Worn Cameras Allows KOHS grant money (from firearms sales) to be used for body-worn cameras. RCT 2016-318

HB 132 Booking Photos Prohibits booking photos from being used for a commercial purpose, if a fee is required to remove them from the site. RCT 2016-319

HB 162 Harassing Communications Adds electronic communications to the Harassing Communications statute. RCT 2016-320

HB 250 Arrest Powers Allows officers to arrest for the misdemeanor offenses of: Possession of Burglar’s Tools Domestic Violence Shelter Trespass Receiving Stolen Property Giving a Peace Officer False Identifying Information (previously false name or address) RCT 2016-321

HB 314 Off Duty Carry EMERGENCY Clarifies that active and retired officers (if properly carrying under LEOSA) may carry anywhere an on-duty officer may carry. EMERGENCY EFFECTIVE IMMEDIATLY RCT 2016-322

HB 428 Animal Cruelty Defines “dog fighting” and adds it specifically to Cruelty to Animals in the First Degree. RCT 2016-324
