2 Background The landscape has changed: Health and Social Care Act Section 251’s National Data Guardian High profile data losses = lack of public and organisational confidence and clarity in sharing information

3 Barriers to sharing Some of the reasons why information is not being shared could be:  Confusion over ‘legal’ basis  Concern about ICO action  Concern about patient choice  Fear of doing the wrong thing

4 What were the local impacts?  Projects were not progressing due to fear of getting data sharing wrong  Confusion over what could be shared and with whom  Organisations waiting for a national solution It was clear that there were blockages in where information needed to flow, in terms of provider to provider and with commissioning organisations.

5 What was the solution? We felt that there needed to be:  Consistency of approach  Documentation which was easy to use  A process to meet the necessary legal and statutory safeguards  Cross organisational and sector buy-in  Sharing of best practice A clear, effective process that staff can implement with confidence and patients will trust and understand.

6 The Solution - Information Sharing Toolkit  Information Sharing Strategy  Information request form  Fair processing notice template  Fair processing posters  Web pages information on Fair processing  Guidance for staff on information sharing  Template information sharing agreement  Patient information leaflet template (including Easy Read format)  Privacy impact Assessment documentation  Data Mapping tool

7 Information Commissioner’s Office Review  South Devon Healthcare NHS Foundation Trust reviewed in October 2015  Feedback from ICO was that the Toolkit was easy to use and comprehensive  Key areas for us:  Implementation and embedding  Ensuring that we document the sharing  Data Quality

8 Next steps  Vanguard – Project Group set up  Looking at the Dorset model with the Information Sharing Charter  Gaining support from Primary Care as part of the urgent care project  In tandem, reviewing the Devon Wide agreement to incorporate the best practice from Dorset and to apply this to organisations in the peninsula
