Copyright Definition Copyright is the legal right granted to an author, a composer, a playwright, a publisher, or a distributor to exclusive publication, production, sale, or distribution of a literary, musical, dramatic, or artistic work.

What does the term Fair Use Mean? There is a test to determine the Fair Use of copyrighted material -Is the material being used for commercial or non profit purposes -the nature of the copyrighted work -the portion of the copyrighted work as a whole -effect of use on potential market value

Music Music may not be copied in its entirety without permission from the holder of the copyright. However, parts of a piece may be used: No more than 30 seconds or 10% (which ever is less) may be used in the confines of a classroom, or for student use. This may not be used on multiple computers, or for extended periods of time.

Music may be used: With original composers permission. Publishers permission. In distance education that complies with the TEACH act.

Motion Media May be used for 3 minutes or 10%, whichever is less. Schools may use a video without paying royalties if it is used in a classroom,and it is part of a regular instructional process. It must be in a face to face teaching activity It must be a lawful copy

Text 10% of the total, or 1,000 words (whichever is less) An entire poem if it is less than 250 words However, no more than 3 poems by one poet may be used Or, five poems in an anthology Music lyrics may be used if 10% or 30 seconds
