2 DEFINITIONS: Project Labor Agreement (PLA): Project owner  labor unions agreement to establish: Safe working conditions and rules Accountability for project execution on the job Protocols for resolving labor disputes Community Workforce Elements (CWA) Part of a PLA to include targeted hiring goals

3 Employment Opportunities Educational Opportunities Skilled Workforce Economic Development Small Business Participation Local and regional economic growth through hiring and support of small business. More jobs means more money back to the community. Increase job access for low-income workers, women, veterans, people of color, and other disadvantaged workers. Connect workers with job training. Provide contractors with access to a trained, qualified workforce. Increase capacity of small minority- and women-owned businesses to compete and participate in public works contracts. 4 Who does the PLA – CWA impact? Construction Purchasers & Labor Organizations that are signatory to the agreements Contractors who have workers covered by prevailing wage Workers who perform work covered under prevailing wage laws Community & Training Partners who commit to provide support services and interact with the project

5 Elements of a Community Workforce Agreement Union Recognition Non-Union worker & contractor right to participate Dispute Resolution Process Accountability in both the Dispatch & Rejection of workers Core Workers Contractor Education Commitment Diversity and Inclusion Strategy (Priority Hire)

6 Union Recognition / Non-Union Inclusion No contractor or worker will need to become a union member to participate, but … Every worker will be represented by the recognized craft union during the life of the project. Non-Union Contractors & Workers NOT required to join unions Unions NOT allowed to organize on the project Grievance issues Safety Pay

7 Dispute Resolution CWA establishes a dispute resolution process, including: Joint Advisory Committee (JAC) Grievance Process Recognition of the Plan for Jurisdictional Disputes Process may be administered by the agency or a third party Designed to eliminate slow downs in progress and payment

8 Accountability in both the Dispatch and Rejection of workers All workers come to the project through the dispatch system Workers prioritized in accordance with CWA guidelines Unions dispatch priority workers based on dispatch request and availability Contractors prioritize requests based on job skill needs and opportunity to meet the criteria Contractors will account for any rejection of workers

9 Core Workers Contractors have “core workers” that they rely on to deliver their work These workers may or may not be union members Non-union contractors must move their “core workers” through dispatch Core workers will be dispatched according to CWA CWA establishes Core Worker definition (active payroll status, etc.)

10 Contractor Education Commitment All parties agree to support contractor education throughout the life of the CWA: Purchaser Contractor Unions

11 Diversity and Inclusion Strategy Priority Hire strategy is central to the CWA Incorporates criteria for targeted worker population Establishes relationship with Community partners & training providers Sets criteria for contractor credit and measurement Establishes Apprenticeship utilization & integration into the project Creates Veteran, Worker of Color, Women & related priority selection tools
