3 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Transposition The Environmental Noise Directive has been almost fully transposed into the national legislation through provisions of the Law on Environmental Noise Protection (OJ MNE 28/2011 of 10 June 2011) Transposition score is 96% (according to PM for 2012) The remaining provisions shall be transposed by planned secondary legislation (2013/Q I 2014)

4 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Transposition - secondary legislation Rulebook on limit values of environmental noise, noise indicators and acoustical zoning (OJ MNE 60/2011 of 16 December 2011) Rulebook on methods for measurement and calculation of environmental noise and contents of reports on measured or calculated noise level - drafting process is ongoing and shall be completed and adopted by the end of 2013 Rulebook on contents and method of making strategic noise maps, will be adopted in the first quarter of 2014

5 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation - compentent authorities Ministry of Sustainable Development and Tourism is competent for drafting the legislation in this area and participates in development of action plans Environmental Protection Agency proposes, implements and reports on annual noise monitoring program, issues permits to accredited laboratories, collects and publishes noise data Concessionaires, Environmental Protection Agency, Ministry of Transport and Maritime Affairs, Local authorities are in charge for development of strategic noise maps

6 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Administrative capacity Proper administrative set-up for development of strategic noise maps and action plans in accordance with the Directive poses an implementation challenge There is a need for staffing, training, software and equipment in order to comply with directive’s requirements

8 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE The Ministry of Sustainable Development and Tourism shall adopt the Rulebook on methods for measurement and calculation of environmental noise and contents of reports on measured or calculated noise level, on the basis of the Article 8 of the Law on protection from environmental noise (OJ MNE 28/2011 of 10 June 2011) The Rulebook drafting process is ongoing and shall be completed and adopted by the end of 2013 Implementation - establishment of noise assessment methods

9 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation establishment of Acoustic Zones Local governments are obliged to determine acoustic zones on their territory Environmental Protection Agency, the Ministry of Sustainable Development and Tourism and UNDP organized a workshop on NOISE ZONING IN MUNICIPALITIES OF MONTENEGRO So far five municipalities have completed the acoustical zoning

10 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation - identified areas for which strategic noise maps and action plans are required Law on protection from environmental noise defines agglomerations as “part of the territory or urbanized area with over 100,000 inhabitants” There is one agglomeration in Montenegro – the capital city of Podgorica There is three major roads with more than 3 million vehicle passages per year There is no major railways with more than 30 000 train passages per year nether major airports

11 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation - preparation of strategic noise maps Preparation of strategic noise maps by 30th June 2017 The Article 12 of the Law on protection from environmental noise provides for establishment of cooperation with competent bodies of neighbouring countries Every five years strategic noise maps shall be reviewed

12 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation - preparation of action plans Action plans shall be prepared by 2019 Action plans for major roads, major railway and major airport shall be approved by the Government Action plans for agglomeration shall be approved by local authorities/local assemblies Action plans shall be regularly reviewed/revised every five years, but it can be done earlier if there have been some significant changes in noise levels

13 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation - involving public This system has been established by Art 18 of the Law on protection from environmental noise which prescribes that the competent authorities for preparation of action plans have the obligation to inform the public and involve them in public consultation process The Competent authority shall organize the public consultation process in accordance with the Governmental/Local Authority Rules of Procedure and make report on public consultation process

14 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation - information to the public Strategic noise maps will be available on the internet site of the Environmental Protection Agency Proposals for action plans will be available through the public consultation process Action plans will be available on the internet site of the body competent for approving the plan Summary of the most important points will be available within the report prepared for the EC

15 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation – deadlines and costs estimation Implementation of the Environmental Noise Directive is at early phase and is directly linked to adoption of secondary legislation Having in mind the fact that development of the Strategic noise maps has been set for 2017 and adoption of Action plans for 2019 the full implementation is expected by 2019 According to the Handbook on the implementation of EC Environmental Legislation, the cost estimated for noise mapping is 0.15 to 2 € per resident
