Purpose Address feedback from development community Clarify design language and permitting standards for rear and side lot fencing, porches, garage placement and orientation, and lot access Make conforming certain previously permitted structures

Ordinance Overview Sec. 38-1384(d) – Front porch – Existing language defines front porch and minimum dimensions – Clarifies that front porches smaller than the minimum dimensions shall not be considered in achieving the required inclusion of qualifying porches on minimum 50% of detached residential structures.

Ordinance Overview Sec. 38-1384(e) – Fences – Existing language for permitted fences in front, side, or rear yards. – Relaxes language regarding opacity above 4 feet in height for rear yard on front loaded lots.

Ordinance Overview Sec. 38-1384(g) – Garages and garage doors – Existing language for placement and design – b. Clarifies that double wide garages are not permitted on lots of less than 65ft except for side-oriented garages

Ordinance Overview Sec. 38-1384(g) – Garages and garage doors – (3)f. Relaxes minimum lot width for J-load garage from 65ft to 60ft and establishes design details

Ordinance Overview Sec. 38-1384(g) – Garages and garage doors – (3)h. Allows permitted garages and garage doors that may not meet design standards prior to January 1, 2016 to be considered conforming structures

Ordinance Overview Sec. 38-1384(i) – Access and off-street parking – (2) and (5) Requires access from rear alley if lot abuts rear alley easement regardless of lot width

Ordinance Overview Sec. 38-1384(l) – Setbacks – Establishes that accessory uses and structures have the same side yard setback requirements as the principle structure – Also 5’ setback from rear lot line - or from rear alley easement line, if it exists.

Ordinance Overview On April 21, 2016, LPA recommended approval of the ordinance Subsequent to LPA approval, staff is requesting three additional changes

Ordinance Overview Sec 38-1384(I) Setbacks LPA Recommendation Setbacks. Accessory uses and structures shall provide minimum five(5) foot setback from the rear lot line of the rear alley easement (when such easement exisits) Staff Recommendation (currently in BCC Agenda Book) Setbacks. Accessory uses and structures shall meet principle structure side yard setback requirements. Also, those use and structures shall provide minimum five(5) foot setback from the rear lot line of the rear alley easement (when such easement exists)

Requested Action Make a finding of consistency with the Comprehensive Plan and approve the Ordinance to amend the Village Planned Development Code with the changes presented today and allow staff to correct any non-substantial grammatical or scriveners errors.
