3 What is Long-Term Stewardship? “Post construction” activities, processes and controls at properties where long-term management of contamination is necessary to protect human health and the environment LTS activities typically include: –Engineering controls –Institutional controls –Monitoring and enforcement

4 Long-Term Controls Engineering Caps and liners Ground water extraction and treatment systems Ground and surface water monitoring Bioremediation systems Fences Institutional Zoning Notices and warnings Easements Restrictive covenants Permits Other land use controls

5 Long-Term Stewardship is Important Ensure long term protectiveness –People –Engineering controls Create Confidence and Credibility Clarify liability for “mothballed” properties Allow faster and more efficient cleanups Return more properties to use ~ 80% of Superfund Sites require LTS Only 30% of transferred BRAC acres are not contaminated

6 Who is Responsible for LTS? Parties responsible for contamination Land owners Affected communities and local groups Developers, financial institutions, insurance companies, environmental trusts Federal, State, Tribal and Local Governments

7 LTS Task Force Long-Term Stewardship Task Force –Representatives from EPA cleanup programs, Regions and States –Charged to examine the LTS issues and recommend potential activities for EPA to consider Report includes 13 Recommendations

8 Long-Term Stewardship Challenges Long-term management of information Clear roles and responsibilities Reliable institutional and engineering controls Accurate life cycle costs Adequate financial assurance and resources Monitoring and enforcement

9 Moving Forward on LTS EPA’s cleanup programs are focusing on: 1.LTS Data quality, collection and accessibility 2.Clarifying and communicating LTS policy 3.Working with local, state, tribal and federal partners to better implement LTS

10 Information Management Improved data quality, collection and accessibility should: –Clarify roles and responsibilities –Allow for stronger enforcement and accountability –Enable development of private monitoring and “one call” systems

11 Land Reuse Measure – A New Incentive Cross-program GPRA measure: –Protective for people –Ready for anticipated use All remedial action goals met Institutional Controls must be in place

12 Communicating LTS Information EPA databases to include IC / LTS information CERCLA IC Tracking System Web sites and tools –Cleanups in My Community –SMARTe –LUCS.org –LUCs Web Ring Support development of state and local systems Support development of data standards
