In June 2008, the State Board adopted requirements for the Oregon Diploma (581-022-1130) In December 2009, the State Board adopted requirements for: Modified Diploma (581-022-1134) Extended Diploma (581-022-1133 Alternative Certificate (581-022-1135) In July 2011, the Legislature passed HB 2283 and HB 2285, which revise the Diploma Options 2

A district may award a modified diploma or extended diploma only if they get consent. If student is under 18, consent from parent/ guardian. If student is under 18 and emancipated, consent must come from student. If student is under guardianship from the courts, consent must come from court-appointed authority. 9

A student may complete the requirements for a Modified/Extended Diploma or Alt. Cert. by the later of: Four years after starting 9 th grade; or The student reaching the age of 21 years. The District’s obligation continues to follow existing laws for FAPE. 10

Consent may not be used to allow a student to satisfy the requirements in less than 3 years. Completing Diploma Options in less than four years requires written consent. Parent/guardian or adult student is waiving the 4 years. Copy of consent must be sent to district superintendent. Each SD must annually provide the number of consents obtained to the State Superintendent of Public Education. Consent may not be used to allow a student 11

Have access to ◦ instructional hours, ◦ hours of transition services and ◦ hours of other services that are designed to: Meet the unique needs of the student; and When added together, provide a total number of hours of instruction and services to the student that equals at least the total number of instructional hours that is required to be provided to students who are attending a public high school. (Grades 9-12 -- 990 hours/year) Total number of hours provided to a student may not exceed 7 hrs/day. 12 Start with 990 hrs/yr

The total number of hours the student receives services will be determined by the individualized education program (IEP) team or by the school team if the student is not eligible for special education. The team must base the decision on the student’s needs and performance level. The IEP Team may decide that the student does not need 990 hours per year. The SD may not unilaterally decrease the total number of hours of instruction and services provided to the student, regardless of the student’s age. 15

Reduction of hours and services requires an annual letter: ◦ SD must inform the parent/guardian of SD’s duty to comply with the total number of 990 hours; and ◦ SD cannot unilaterally decrease the total number of hours of instruction and services. SD must obtain a signed acknowledgement from the parent/guardian of the student that they received the information. Include in IEP a written statement that explains reasons the student is not accessing the total number of hours of instruction and services 16

The IEP team may decide that the transition services or other services may be provided by another agency through an interagency agreement. The SD retains the responsibility for access to the total number of service hours. An agency is not required to change any eligibility criteria or enrollment standards prior to entering into an interagency agreement. 17

A school district or public charter school shall: Ensure that students have on-site access to the appropriate resources to achieve a high school diploma, a modified diploma, an extended diploma or an alternative certificate at each high school in the school district or at the public charter school. 18
