Familial Status Asking the marital status of prospective tenants could be dangerous if the tenants later claim that the refusal to rent to them was based on their marital status. H. ADVERTISING Discriminatory advertising is prohibited by the Civil Rights Act of 1968. Advertising of singles or even a preference for adults would be discriminating.

AMERICANS WITH DISABILITIES ACT The Americans with Disabilities Act makes it discriminatory to deny equal enjoyment of goods, services, facilities, and accommodations in an existing place of public accommodation (nonresidential). An owner can change more for sale or lease of handicapped. K. EQUAL CREDIT OPPORTUNITY ACT Applicants CANNOT be refused because of race, color, religion, national origin, sex, marital status, age or because the source of income is public assistance.

9 II. Fair Housing (State) The UNRUH ACT provides for actual damages plus $250 for each offense. California’s RUMFORD ACT provides that an owner or manager could be required to rent another available unit to the person discriminated against and be subject to a $10,000 civil penalty.

Fair Housing Partnership Agreement (FHPA) 1) Sharing responsibility for the achievement of fair housing, identifying fair housing issues and concerns; 2) Developing measurable strategies and actions to address identified issues and concerns; 3) Evaluating the process of actions taken; and 4) Determining future strategies and actions based on that evaluation.

11 IV. Ethics Ethics is simply doing what is right. Ethics is the application of the oldest rule for distinguishing right from wrong—The Golden Rule. Good ethics is good business.
