Vigita Vėbraitė Recent developments of mediation in Lithuania Vilnius University

Still mediation is a new phenomenon. This steps of court-annexed mediation were in year 2005. The Law on mediation in civil disputes came into force on the 1 st of January 2010.

Some statistics Only about cases of court- annexed mediation. In 2013 – 37 mediation cases (only 2 settlements reached); in 2014 – 53 of such cases (12 reached settlements). In year 2015 – 123 cases (39 successful cases). In year 2013 there were 37 such cases

New initiatives New conception on mediation confirmed by the Government in January of 2015. Draft law has been created and now submited to the Government. Judicial Council and National courts administration much more active in the sphere of court-annexed mediation.

Main ideas of the draft law Could be applied not only for civil disputes. Requirements for mediators and the list of mediators. Introduction of mandatory mediation for family matters and small claims civil disputes ( up to 1 500 Euros).

Still main challenges Still not well known among public and lawyers. Litigious culture. Financing of the State is needed to promote mediation. Public consultations on the directive is going on in EU.
