What’s a Cyber Mark? REVIEW: A trademark is a distinctive symbol or slogan used by a business to distinguish itself from other businesses. A cyber mark is a cyberspace reference to the term trademark.

Domain Name A business’s web address is often a distinctive label for a business. A domain name is a unique group of words that make up an Internet address (aka URL). (www.google.com)www.google.com

Who Owns it? The second-level domain (SLD) is the name that indentifies the owner of the Internet address. The SLD of this Internet address is Google.

Two separate businesses with the same name? Business can use the same name without conflict if: The business is small The goods and services are not the same The purpose of the businesses are not the same

Infringement In cyberspace, no two businesses can use the same domain name. A business can share an unregistered trademark (Acme TM ), but no two businesses can share the same domain name http://www.acme.com and http://www.acme.com http://www.acme.com The unauthorized duplication of another’s domain name is trademark infringement.

What’s Meta Tagging? Website designers insert key words into their website so that their website will be displayed when a user enters specific words in a web search. Meta tags are key words that are scanned when a user uses a search engine to find a website.

Malicious Meta Tagging Malicious meta tagging may occur when a website designer inserts meta tags that are associated with another popular website so that their website will appear in the same search results.

Meta Tag Example Delta Computers sells top quality computers with an amazing reputation. E-products is a newer business that is trying to get attention of new customers. E-products maliciously places “Delta” as meta tags on their website so that E-products website will appear in the same search results as those searching for “Delta”

What’s Trademark Dilution? Trademark dilution occurs when a trademark of another is used to damage their reputation. Example: www.candyland.com as the domain name of an inappropriate website may diminish the “Candyland” trademark of the children’s board game.www.candyland.com
