Chapter 1: Sloboda kretanja roba M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Sloboda kretanja roba Transposition The Regulation 2004/648 has been mainly transposed into the national legislation through provisions of the Law on Chemicals (OJ MNE 18/12 ) The remaining provisions shall be transposed by planned secondary legislation: 1.Rulebook on methods of test for biodegradability of surface active substances 2.List of surface-active substances that may be used in detergents 3.List of surface-active substances which are prohibited for use in detergents 4.Rulebook on method of marking and content of the detergent composition list

Chapter 1: Sloboda kretanja roba M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Sloboda kretanja roba Competent Authorities Ministry of Sustainable Development and Tourism is competent for drafting the legislation in this area Environmental Protection Agency issued license for the use of surface-active substances, verify whether the detergent is used, collect technical dossier of the surface-active substance Environmental Protection Agency may specify conditions for the marketing and use of surface-active substances as a detergent ingredient Also, Agency may issue a: - New license setting the conditions for using the surface-active substance; - Decision revoking the license

Chapter 1: Sloboda kretanja roba M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Sloboda kretanja roba Implementation Testing for biodegradability to surfactants Tightened the biodegradability testing requirements for surfactants in detergents Required fuller contents information to be provided on detergent labels Required manufacturers to produce data sheets to provide medical professionals with more information when treating allergies, as well as a less detailed data sheet available to everyone.

Chapter 1: Sloboda kretanja roba M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Sloboda kretanja roba Implementation – inspection and enforcement system Inspection supervision over the enforcement of Regulation on Detergents performs Environmental Inspector and Trade Inspector Environmental inspector have the authority to determine whether: 1.prohibit placing detergents on the market which do not comply with the prescribed obligations of the detergent industry
