1 PATERSON INLET MARINE RESERVE PROPOSAL Minister of Conservation has approved the establishment of a marine reserve in Paterson Inlet BUT BEFORE THE MARINE RESERVE CAN BE ESTABLISHED the Ministers of Fisheries and Transport must first concur with the Minister of Conservation’s decision

2 Minister of Fisheries must independently concur with the Minister of Conservation’s decision to not uphold any objection. Minister of Fisheries is required to make his own independent decision.

5 Concurrence Minister of Fisheries must independently consider the following Whether or not the marine reserve will: (a)Interfere unduly with any estate or interest in land in or adjoining the proposed reserve (b)Interfere unduly with any existing right of navigation (c)Interfere unduly with commercial fishing (d)Interfere unduly with or adversely affect any existing usage of the area for recreational purposes (e)Otherwise be contrary to the public interest

6 The Minister of Fisheries: when considering whether the proposed reserve would interfere unduly with commercial, recreational or customary fishing interests, must weigh any impacts that the Proposed reserve may have on those Fishing interests against the public Benefits derived from the marine reserve.

7 While the Minister of Fisheries has obligations under the Marine Reserves Act, he also must consider his obligations under the: Fisheries Act 1996 Treaty of Waitangi (Fisheries Claims) Settlement Act 1992 and Act in a manner consistent with the Treaty of Waitangi
