Contested and uncontested divorces are the two types of divorce available in most states. divorce The differences are simple to understand, but the process for either type of divorce can be quite complex.

Uncontested Divorce Uncontested divorce is considered a simple process. The spouses come to an agreement on all issues of the divorce without going to trial. Most couples prefer uncontested divorce because it is convenient and far better than going to trial. It also allows both parties to resume to their lives quickly.

Contested Divorce A contested divorce occurs when either party is unable to agree to the terms of divorce. Most common disagreements are over child custody, property division and alimony. Both parties must file court documents. They rely on a judge to make the decision for them.
