3 Moratorium  Prohibits the issuance of any permits or licenses related to the establishment of a medical marijuana dispensary Extending the Urgency Ordinance allows additional time for the City to evaluate and develop standards (up to one year) Extending the Urgency Ordinance allows additional time for the City to evaluate and develop standards (up to one year)  City may continue to accept and process applications for such uses until such time as the moratorium is lifted by the City Council or expires pursuant to State Law

4 Background  1996 – California voters enacted Compassionate Use Act  Permits possession and cultivation of marijuana for limited medical treatment purposes  January 1, 2004 – Medical Marijuana Program enacted  Clarifies and expands scope of the Compassionate Use Act  Allows a primary caregiver to provide medical marijuana to an unlimited number of qualified patients who possess ID cards and reside in same city or county as primary caregiver  California Law conflicts with Federal Law

5 Regulation  Medical Marijuana Dispensaries  Possible Location Restrictions  Elementary Schools, high schools, public libraries, or parks  Youth-oriented establishments  Residentially properties  Conditional Use Permit  Provide adequate parking  Security  Restrict smoking of medical marijuana on premises of dispensary  Restrict consumption of medical marijuana or marijuana enhanced products on premises of dispensary  Trash collection and disposal requirements  Business License

6 Regulation  Employees and Operators  Employee permit  Background Check from Chief of Police  Amount of Medical Marijuana on the Premises/Consumption  Possession of no more than eight ounces of dried marijuana per qualified patient  Maintenance of no more than 6 mature or 12 immature marijuana plants per qualified patient  Exception to amount of possession based on doctor’s determination that patient need exceeds possession limitation

7 Recommendation  Adoption of urgency ordinance extending the Temporary Moratorium to one year  Imposes Moratorium on establishment of medical marijuana dispensaries  Provides Council sufficient time to examine potential impacts to public health, safety and welfare
