Discipline Review 2016-2017 Coding discipline in eSchool, based on PEIMS Data Standards, as given by the TEA

When to create a discipline incident in eSchool Any discipline action that removes a student from a class or classes, for any part of a day, must be reported to the TEA via PEIMS If the discipline action taken meets the above criteria a discipline incident must be entered into eSchool 3

What information should be reported? The Discipline Action Reason which indicates why the student is in trouble The Discipline Action which indicates what punishment is being given – ISS, OSS, DAEP, or JJAEP The Behavior Location which indicates whether the incident happened on/off campus, at a school related activity, etc. The length of the discipline action(s) The date of offense (incident date) All offenders involved in the offense 4

Discipline Action Reason Codes The reasons students may be removed from their regular classrooms can be grouped in three categories – Non Mandatory offenses – Mandatory DAEP offenses – Mandatory JJAEP (expulsion) offenses 5

Non Mandatory Action Reason Codes Action Reason Code 01 – Permanent removal by teacher from class – Permanent ban of the student by the classroom teacher from their classroom – Behavior must occur in the classroom – Teacher must document repeated behavior and deny right to return to their classroom 6

Mandatory DAEP Action Reason Codes The following behaviors must occur at school or at a school sponsored activity, whether on or off campus These behaviors require law enforcement verification before categorizing a student with one of these Action Reason Codes (must have police report) 14

Mandatory Expulsion Action Reason Codes Action Reason Code 11 – Used, exhibited, or possessed a firearm – This does not include BB guns, pellet guns, or air-soft guns Action Reason Code 12 – Used, exhibited, or possessed an illegal knife – Knife blade must be greater than 5.5 inches 22

Discipline Action Codes Discipline Action Codes are the codes used to describe the consequences given to a student for the offense they committed. Multiple codes may be used for each offender – For example a student may receive an out- of-school suspension (OSS) as well as a DAEP placement 30

Discipline Action Codes Action Code 06 – In-School Suspension – Max number 30 days, 10 days consecutively – Attendance must be taken but teacher, students MAY NOT take attendance – Sign In sheets MAY NOT be used!! Action Code 05 – Out-of-School Suspension – Can not assign a student to more than three (3) days of OSS – A partial day suspension counts as one of the three allowed 31

Discipline Action Codes Action Code 27 – Mandatory disciplinary action not taken as a result of ARD committee manifestation hearing determination, made in accordance with IDEA for a student receiving special education services, that the student’s behavior is linked to the student’s disability 33

Discipline Action Codes Action Code 28 – Mandatory DAEP/JJAEP placement not taken because the district considered one or more provisions that allows the district to consider self defense, intent or lack of intent, student’s disciplinary history, or disability that substantially impairs the student’s capacity to appreciate the wrongfulness of the student’s conduct as a factor in a decision to order suspension, removal to a DAEP, or expulsion 34

Special Education Students The placement of a student with disabilities in JJAEP, who receives special education services, may be made only by a duly constituted Admission, Review, and Dismissal (ARD) committee Under federal rules and regulations, special education student must be allowed to continue their education program regardless of what behavior they have committed 35

Things to Remember If a student is given out-of-school suspension any part of a day counts as a full day for state reporting purposes A student may not be given more than three (3) days of out-of-school suspension for any given discipline incident If coding a student with fight/mutual combat there must be two offenders entered under one discipline incident 38

Things to Remember Remember that if multiple students are involved in an incident there should only be one incident entered…multiple offenders can be coded under a single incident Do not add extra days to the original action length for behaviors that occurred after the initial incident – For example a student is sent to in-school suspension for disruptive behavior in the classroom. While in ISS the student continues their disruptive behavior and another 2 days of ISS is tagged onto the end of there stay. This should be coded as a separate incident. Do not add the extra 2 days of ISS to the original incident length. 39

Things to Remember Your attendance date and discipline MUST match! The state will audit this data to verify that a student in ISS/OSS is marked accordingly in attendance data. (There is a report for this!) DATES MATTER! If the student’s placement dates change for ANY reason ( more/fewer) this must be indicated on the incident in Discipline. It will be compared to the attendance data. 40

Things to Remember Please make sure your incident comments support the action reason code given – For example if you use code 21 (code of conduct violation) make sure the comments don’t say something along the lines of ‘student was caught with marijuana’ Make sure you enter your discipline data in a timely manner. All incidents should be entered into eSchool within one full school day of the incident’s occurrence 41

New eSchool User's All staff, who have not gone through basic discipline entry training, and will be entering data into eSchool are required to go through a basic discipline data entry course – Returning users who would like a refresher are also welcome! 43

DAEP Procedures Remember to enter the discipline incident into eSchool prior to withdrawing the student and sending them to DAEP Make sure you have followed the the NEW procedures for sending the student to DAEP, this will make the transition easier on everyone 44

46 To begin the process you will click on the Request a Davis Placement link The first screen allows you to see if there are available seats for that grade level

47 On this screen, you can see all your prior requests. You can also search those requests by date. Or you can request a new Davis placement by clicking the blue link at the top left corner.

48 You will need to enter the student’s ID number, name, grade, gender and your campus name. Next, you will need to enter the Discipline code, # of day for placement, Incident #, type of placement (either mandatory or persistent),the requested DAEP state date and reason with clear detail.

49 Lastly, you will need to check the student’s current programs, qualifying condition, and ARD meeting date, time, and exit date if required.
