Ethics and good governance Ethics are a part of the classic philosophy: a way to develop basic principles for the best possible behaviour in a social group Good governance is a practical implementation of ethics, particularly regarding management of entities Ethics and good governance principles must be respected by all NOCs of whatever size and cultural influence: they are universal principles

Ethics and the Olympic Movement As stated in the Olympic Charter, in point 1 of the Fundamental principles of Olympism, Olympism is the philosopy of life based on the respect for universal fundamental ethical principles The IOC Code of Ethics is part of the Olympic Charter (Rule 22) At all times, all the NOCs must respect and ensure the respect of the IOC Code of Ethics

A necessity to respect the Fundamental principles of Olympism and the Olympic Charter A necessity to strengthen autonomy: there can be no autonomy if it is not served by good governance practices Regarding all NOC’s partners: a necessity to win respectability, confidence and liability - a win-win process

The IOC Code of Ethics Individual dignity -No discrimination -No doping -No form of harassment -No betting on the Olympic Games Moral Integrity -No direct or indirect form of remuneration or benefit connected with the organisation of the Olympic Games -No gifts -No conflicts of interest -No behaviour likely to tarnish the reputation of the Olympic Movement -No activities inconsistent with ethical principles You can have your own Code integrating the basic principles or refer to the IOC Code of Ethics

Universal basic principles of good governance There is no absolute definition of the concept of good governance; however, it is important to take into consideration the principles brought forward by the Olympic Congress about good governance; transparency, access to information, efficiency, conformity in imputation of expenditure etc. Even if each NOC is unique, in its juridical environment and its own operations, the application of the principles of good governance is essential for all NOCs. It is the responsibility of every leader / person in charge to disseminate the spirit and the respect of good governance throughout the organisation. This is applicable to professional and voluntary leaders.

Universal basic principles of good governance The Olympic Congress approved the document named “Basic universal principles of good governance of the Olympic and Sports Movement” as a minimum standard Draw your attention to the three main themes of this document Transparency Responsibility Respect of the NOC’s mission

Good governance basic principles: Transparency Transparency of the Rules: -Texts (Statutes, Rules and Implementing Provisions) must be clear and include a revision process -Texts must be accessible via publications Financial Transparency -Financial commitment transparency - tender process -Disclosure of financial information on an annual basis at least -Accounts in accordance with generally accepted accounting principles; income and expenditure shall be recorded in the accounts (Code of Ethics C.2.1) -The accounts must be checked by an independent and qualified external auditor - internal and independent auditors are recommended must be accessible via publications Accounts need transparency -Transparency of management (agenda-documentation) -Transparency of managers (job descriptions - objective criteria for recruitment. -Transparency of risk-management.

Good governance basic principles: Responsibility *Share responsibility: Clear tex on the respective responsibilities (political / management decisions) *Controlled responsibilities: Clear and regular reporting from elected and appointed office holders *Regular and legitimate elections *Right to appeal about all forms of disciplinary measures *Respect of minorities: respect of the right of expression (freedom of speech)

Good governance basic principles: Responsibility - no conflict of interests * No conflicts of interest - It is the individual responsibility to avoid any conflict of interests *There is a conflict of interests when a decision or opinion may be considered as liable to be influenced by relations the person has, has had or is about to have, with a third party. *The appearance of a conflict of interests must be considered as a situation of conflict of interests

Good governance basic principles: Respect of the mission The mission is the development of sport Money from sport must go to sport Olympic resources must be used only for Olympic purposes (Code of Ethics C.2.2) -the use of Olympic resources for Olympic purposes must be clearly demonstrated in the accounts -the accounts may be subject of auditing by an expert designated by the IOC Executive Board -Equitable distribution of resources on objective criteria *Development of sport by listening to the athletes - NOC Athletes Commission to be part of the decision process

In the event of non-respect of the good governance principles No transparency means: -decision insecurity -risk of favouritism -arbitrary No responsibility means: -risk of dictatorship -abuse of leading (dominant) position -certainty of corruption *Non-respect of good governance principles means loss of credibility towards all your partners

Authority of reference Your own ethics and good governance commission; but its independence must be firmly guaranteed -By a majority of members of a high reputation and not involved in the NOC and -By statutes providing a term of reference - a term of appointment (eg for four years) -With rules of procedure including the respect of the right to be heard and the list of possible sanctions Consultation of the IOC Ethics Commission - If the NOC does not have its own Commission and needs advice -Or for advice on a previous similar situation *Consultation of the IOC Ethics Commission Secretariat for technical advice and follow-up of the Olympic Solidarity Forum

Conclusion Implementing the principles of ethics and good governance is more than fulfilling the Olympic Charter’s requirement, it is disseminating the Olympic values to leave a positive legacy for the whole Olympic family, the local community and the youth of the world.
