2 Health Policy Space & Right to Regulate Today’s main health challenges in the EU: chronic diseases overweight obesity Regulatory cooperation could significantly limit the Health Policy Space & constrain the “right to regulate” of the EU and its Member States in the public interest

3 Public Health Legislation as „Red Tape”? Key risk factors: alcohol tobacco nutrition Public health measures as irritant to trade? end-price (taxation, subsidies or minimum pricing), availability (promotional measures, advertising and marketing regulations) accessibility (school environments)

4 Technical Cooperation vs. Public policy 1. I n clearly defined sectors only, and 2. Sector selection should be based on solid and inclusive impact assessment Is a horizontal Regulatory Cooperation Chapter in TTIP really needed for achieving the potential benefits? Technical cooperation is already happening Potential benefits (medical devices, pharmaceuticals, complementary and alternative medicines (CAM) and antimicrobial resistance (AMR) BUT...

5 Maintaining European Standards (laws & technical standards) Towards the global lowest common denominator level? against the economic interests of a knowledge- based economy like Europe Any alternative?  sectoral mutual recognition agreements?  finances & staff for regulatory agencies?  international regulatory cooperation?

6 Regulatory Cooperation and Democracy Regulatory processes may gradually appear detached from the policy preferences of the regulated, or from the agreed policy choice, in the case of existing regulations transparency parliamentary scrutiny accountability Public interest civil society involvement
