TM2-06 CONDITION 20 – MODIFICATION 20. The ODS shall be responsible for 100% of the cost of design and construction of a traffic signal and intersection improvements at the Charter Way and Tillie Lewis Drive intersection, as identified in the approved Initial Study/Mitigated Negative Declaration (IS3-06). The ODS may request reimbursement of previously collected proportionate shares subsequent to the completion and acceptance of said improvements. Per City Municipal Code Section 16-355.050, the ODS may request the City to form an Area of Benefit for reimbursement of public improvement costs beyond their proportionate share.
