September 2016 Update Texas Attorney General’s Opinion Does Request Apply to Classroom or School or District? Texas AG’s Response …upon receiving a request, a school district shall provide equipment not to a single classroom but "to each school in the district" … Each school receiving equipment must place, operate, and maintain a camera in “each classroom” … providing special education services. Texas AG’s Response The AG says, “Given the anticipated expense of providing this equipment … it would seem reasonable to allow a requestor to limit the expanse of his or her request to one specific instructional setting. September 2016 Update Texas Attorney General’s Opinion How Should we define “Staff Member?” Texas AG’s Response A rule defining "staff member" to include only a teacher, related service provider, paraprofessional, principal, etc. … imposes additional restrictions in excess of the plain language chosen by the Legislature. A court addressing such a definition would likely conclude that the Texas Education Agency has exceeded its rulemaking authority by adopting a rule contrary to the statutory provisions. Pflugerville Security Standards: Technology will retain cameras in stock at all times to fulfill immediate SB507 requests. Cabling and Video Surveillance vendors are aware that installation for SB507 requests must be completed within timeframe established by PfISD. Technology has conducted walkthroughs of each campus’ self- contained as identified by the principal. Technology will indicate predetermined locations for cables and cameras to help expedite the process. Cameras must provide a view of the entire classroom and include audio. This may require multiple cameras in certain classrooms.

Proposed Process: 1.Camera request sent via e-mail from Executive Director of Special Education to Executive Director of Technology Services. a)Superintendent, Deputy Superintendent, or their designee, shall be copied on the e-mail message. b)E-mail message must list the individuals who require access to view camera video. 2.Help Desk Ticket shall be created for tracking and will be flagged as Critical/VIP issue. 3.Cable & Video Surveillance Vendors are notified on date of ticket creation. 4.Date of completion will be requested of vendors 5.Technology confirms, and documents date of, installation 6.Camera access shall be accessible via the PfISD video security software by individuals specified in the email request. 7.Video and Audio data shall be archived for 6 months as per SB 507. 8.Camera and Audio equipment shall remain in place until notification is received via email from Executive Director of Special Education and approved by the Superintendent or designee.

Pending Clarification: Does video need to be edited (blurred) to prevent viewers from seeing students other than those involved in the request? Have minimum specifications for the video and audio quality been identified? Funding Estimates: 53 classrooms identified as of June 2016.
