1 The role of Medical Providers in Reporting and Referring Alleged Child Abuse Leslie Strickler, DO FAAP Medical Director, UNM Child Abuse Response Team (CART) June 27, 2016

2 New Mexico Legal Code 32A-4-3. Duty to report child abuse and child neglect; responsibility to investigate child abuse or neglect; penalty. A. Every person, including a licensed physician; a resident or an intern examining, attending or treating a child; a law enforcement officer; a judge presiding during a proceeding; a registered nurse; a visiting nurse; a schoolteacher; a school official; a social worker acting in an official capacity; or a member of the clergy who has information that is not privileged as a matter of law, who knows or has a reasonable suspicion that a child is an abused or a neglected child shall report the matter immediately to: (1) a local law enforcement agency; (2) the department; or (3) a tribal law enforcement or social services agency for any Indian child residing in Indian country.

3 Responsibilities of Clinicians Report to Children Youth and Families Department (CYFD) To report Child Abuse Statewide: Statewide Central Intake (SCI): 1-855-333-SAFE (7233) Or #SAFE from a cell phone

4 Responsibilities of Clinicians Suspected abuse or neglect on tribal land Report to Appropriate Department of Tribal Social Services and police department Engage UNM social work with assistance finding contact information. Report to CYFD if necessary for courtesy coverage

5 Responsibilities of Clinicians Report to appropriate law enforcement agency for immediate safety concerns or evidence collection may be necessary Albuquerque Police Department: 242-COPS Bernalillo County Sherriff: 867-2304 Outside of metro area: New Mexico State Police or local police department CYFD and Law Enforcement are required to cross report, but this does not always occur immediately

6 Documenting Reports in Firstnet (ED and Peds urgent care) Add Power Orders Select ED Appointments and Referrals Scroll to Pediatric Specialty Care Select the Child Abuse/Neglect Report Form

7 Documenting Reports in Powerchart Select “AdHoc” charting on tool bar under your patient Go to “All Items” Scroll to “Patient Care” folder Click on “Child Abuse/Neglect Report Form” Complete form and save to chart

10 Not sure if a report has been made? Select “Form Browser” on left hand menu panel Search text rendition by date You can edit or delete the form by this method

12 Reporting Tips Objectively discuss your duty to report with the family unless you feel the disclosure will compromise the safety of the child or others Have detailed demographic information available (parent/guardian name, phone #, address, etc)

13 Reporting Tips You will be asked if you want to remain anonymous It is recommended that you identify yourself and provide contact information so CYFD can follow-up and/or request additional information if necessary Reporter identity is confidential

14 Child Abuse Response Team (CART) Consultation CART notification/consultation request should occur when a child presents to care with injuries causing concern for physical abuse or a situation that is worrisome for neglect.

15 How Do I Request Consultation? Outpatient consultative service is offered Monday through Friday 8:30 AM-4:00PM via the Program Coordinator pager Pager 951-2509 Attending on call (24/7) may be directly reached via contact information published on www.amion.com www.amion.com Inpatient consults are provided daily as needed, including weekends

16 After Hours For patients seen after hours, contact the CART message line : 925-4495 From inside the hospital dial 5-4495 Indicate patient name, DOB, brief HPI, and follow-up needs. Indicate whether CYFD and/or law enforcement is involved and any appropriate contact information.

17 Consultation for Evaluation of Possible Sexual Abuse Determine on-call provider through PALS Pediatric Sexual Abuse team – Para los Ninos Immediate consultation typically indicated if alleged assault has occurred < 72 hours prior to presentation to care For more remote allegations, patients are referred to Para los Ninos Clinic as outpatient 272-6849 to schedule CART consult is not necessary for allegations of sexual abuse only

18 Take Home Points Physicians are mandated reporters of concern for child abuse The requirement to report is based on reasonable concern, not proven abuse Child abuse is an under recognized and under reported health care problems that escalates in severity without intervention.
