Non-Financial Aid Issues that Affect Federal Eligibility Nick Zika Program Coordinator II Iowa State University

Introduction This session discusses the eligibility requirements for students and parent borrowers and your responsibilities to ensure that recipients qualify for their aid awards.

School-Determined Requirements Academic Qualifications Students must have one of the following: A high school diploma GED, state-sanctioned test, or diploma-equivalency certificate Homeschooling at the secondary level (defined by state law) Has completed an ability-to-benefit alternatives and is enrolled in a Eligible Career Pathway Program: – Passing an independently administered DoE approved ATB test – Complete 6 credit or 225 clock hours applicable to a post-secondary degree – Complete a State process approved by the Secretary of Education Currently none have been submitted to the Secretary

Satisfactory Academic Progress (SAP) Students must: Maintain a “C” average (2.0 GPA) May be staggered based on year in school Maintain a institutional-determined pace of completion/progression Complete their program within 150% of the published length of the program

Enrollment Status Students must: Be enrolled at least half-time to receive federal loans School determines full time status w/in FSA standards Students may: Be enrolled > half time for Pell, TEACH, and Campus-Based

Drug Conviction Must be a federal or state drug conviction Possession or sale of drugs Offense occurred while student was receiving aid Exception: Drug Trafficking Conviction (Felony) Conviction results in loss of eligibility for specified period Eligibility can be reinstated

FSA Qualified Drug Rehabilitation Program Must include at least 2 unannounced drug tests and satisfy at least one of the following: Qualified to receive funds from a federal, state or local government program Qualified to receive payment from a federally or state-licensed insurance company Administered or recognized by a federal, state, or local government agency or court Administered or recognized by a federally or state-licensed hospital, health clinic, or medical doctor

Citizenship A student must be one of the following to be eligible to receive federal student aid: A U.S. Citizen or National A U.S. Permanent Resident or other eligible noncitizen Those working towards Permanent Residency A citizen of the Freely Associated States

Citizenship No-Match CPS will set SAR Comment Code 141 or 146 for records that could not be confirmed with data match Acceptable documentation (must provide original): U.S. Birth Certificate U.S. Passport Form FS-240, FS-545, DS-1350 Certificate of Citizenship (N-560 or N-561) Certificate of Naturalization (N-550 or N-570)

Eligible Noncitizen CPS will set SAR Comment Code 046, 105, 109, 142 or 144 for records that could not be confirmed with data match CPS will conduct automatic secondary confirmation If automatic secondary confirmation fails, paper secondary confirmation is required

Ineligible Students Students with nonimmigrant visas: F-1, F-2, M-1, NATO, A2, A3,B-1, B-2, J-1, J-2, H series, and G series Family unity status determined by the Family Unity Program Temporary residents Illegal aliens under the legalization (amnesty) program Students with “Temporary Protected Status” Deferred Action for Childhood Arrivals (DACA) Students with a “withholding of removal” order

Unique Circumstances Victims of Human Trafficking Eligible per the Victims of Trafficking and Violence prevention Act Must provide an I-94 with T1, T2, T3, or T COA code FAA must contact U.S. Department of Health and Human Services Battered immigrants-qualified aliens May be eligible per the Violence Against Woman Act Must submit I-360 to USCIS resulting in a Form I-797 Jay Treaty (1794) Native Americans born in Canada with at least 50% blood quantum Eligible under Section 289 of the Immigration & Nationality Act (INA)

DHS Paper Secondary Confirmation Student may need to provide documentation: Permanent Resident Card or Resident Alien Card Passport with MRIV (temporary Permanent Resident Card) Form I-94 or I-94A (Departure Record) with specific notation* Form I-571 (Refugee Travel Document) Form I-327 (Permit to Reenter) FAA must submit USCIS Form G-845 DCL GEN- 10-07 must mail to Los Angeles, California not Buffalo, New York* USCIS will reply with letter

USCIS Responses Eligible Lawful Permanent Resident Conditional Permanent Resident Applicant granted asylum or refugee status Applicant paroled into the U.S. under Section 212 of the Immigration and Nationality Act U.S. Citizen Cuban/Haitian entrant in the U.S. American Indian born in Canada to whom provisions of the INA 289 apply Ineligible Applicant is employment authorized in the U.S. as indicated Applicant is not employment authorized in the U.S. Nonimmigrant Deferred Action for Childhood Arrivals Temporary Protected Status Withholding of Removal

USCIS Comments “Unable to process request without an original consent of disclosure statement signed by the applicant. Resubmit request” “No determination can be made because insufficient information was submitted. Obtain a copy of the applicant’s most recently issued immigration document. Submit a new request” “Copy provided of applicant’s immigration document is illegible” “Unable to verify status based on the document provided”

NSLDS Financial Aid History Students typically not eligible if in default, owes an overpayment, has over-borrowed, convicted of fraud involving FSA funds, or has a property lien due to federal tax debt CPS matches the student against the NSLDS database CPS may flag a record with “Unusual Enrollment History” SAR Comment 359 and 360

Unusual Enrollment History (UEH) UEH Flags of 2 or 3 (SAR Comment Code 359 & 360) must be resolved by FAA UEH of 2 requires the FAA to check the student’s enrollment and aid record for the past 4 award years UEH of 3 requires the FAA to check the student’s academic credit for the past 4 award years Must determine if student is purposely enrolling to receive aid then withdrawing May need to have student explain the UEH

Selective Service Male citizens and noncitizens age 18-25 are required to register Male students may register 30 days before 18 th birthday Determine by sex at birth Males can register online (www.sss.gov), at the post office, by mail, via FAFSA, or by high school registrarwww.sss.gov

SS Registration Exemptions Males under the age of 18 as of the date the FAFSA was filed Males who served active duty in the armed forces but did not register before age 26* Citizens of the Republic of Palau, Marshall Islands, or the Federated States of Micronesia Noncitizens who entered the U.S. after age 26* Transgendered males assigned the sex of female at birth Males born before 1960 Males enrolled in any office procurement program at The Citadel, North Georgia College and State University, Norwich University, Virginia Military Institute, Texas A&M University, or Virginia Polytechnic and State University Males that are commissioned Public Health Service on active duty or member of the Reserve of the Public Health Service on specified active duty

Failure to Register Males over the age of 26 cannot register SAR C-Flag will be added to the ISIR Student must submit Status Information Letter to SS https://www.sss.gov/Registration/Status-Information-Letter FAA must determine if student knowingly/willingly failed to register Where the student lived when he was age 18-25 Whether the student claims he thought he was registered Why the student claims he was not award of the widely publicized requirement to register FAA decision is final and cannot be appealed
