How Elizabeth Warren’s Senate Seat Might Not Have Temporary Appointment Governor Charlie Baker (R) Replaces Warren’s Open Senate Seat With Appointment As Governor of Massachusetts, Charlie Baker appoints a temporary replacement to fill a Senate vacancy until a special election can be held to permanently replace the Senate seat Since Baker is Republican, the replacement would likely be conservative, which could undermine the Democrats’ chances of regaining the Senate this fall But… File Intention to Resign Early To Avoid Appointment Under Massachusetts election laws, a special election must be held 145-160 days after an intention to resign letter has been filed Therefore, the countdown to a special election would not take place when Warren vacates her Senate seat, but when she files her intention to resign If Warren files her intention to resign while running for VP early, the special election countdown could run out before Warren vacates her seat and Baker can make a temporary appointment to her Senate seat Senator Elizabeth Warren (D)

Elizabeth Warren Submits Intent to Resign Letter After being nominated to be the Democrat’s vice-president nominee, Elizabeth Warren submits a letter indicating her intention to resign 145 days before Inauguration Day on January 20. This begins the countdown for the special election deadline. Hillary Clinton Wins the General Election and Warren Becomes the Vice-president Elect If Clinton wins the general election, Warren would become vice-president elect and would give up her Senate seat in August. Warren Is Sworn in As Vice President of the United States and the Special Election For Her Open Senate Seat Takes Place Around the time Elizabeth Warren is sworn in, a special election would take place because the deadline would be up. This would remove the possibility of a Republican appointed Senator filling the Senate vacancy. Hillary Clinton Wins the General Election and Warren Becomes the Vice-President elect and Files Her Intention to Resign Letter After Clinton wins the general election, Warren files her intention to resign letter. This initiates the 145-160 day countdown for when the special election has to take place. Elizabeth Warren Is Sworn As the Vice President and Governor Baker’s Senate Appointee is Sworn Into the Senate Since the deadline for the special election has not passed, Republican Massachusetts Governor Charlie Baker can appoint someone to fill Elizabeth Warren’s vacant Senate seat and that person is sworn in on Inauguration Day. Special Election Is Held For Warren’s Senate Seat: The deadline passes and the special election is held for Warren’s open Senate seat. This gives Gov. Baker’s appointee three months in the Senate before the election takes place. Given Massachusetts’ Democratic leanings, it is likely a Democratic Senator would be elected to replace Warren. However, it is not unprecedented for an Republican upset like Scott Brown’s election to fill Ted Kennedy’s seat in 2010.
