Regionalpolitik Current EGTC Regulation Legal basis: Article 178 TFEU (ex-159) – Cohesion Policy Recital (16): legislation of a third country or agreements between Member States and third countries so allow Experience: 31 set up; 1 with Serbia (Bánát Triplex Confinium)

Regionalpolitik COM amending proposal Additional legal basis: Articles 209 and 2012 TFEU – External cooperation Article 3a: Member State where EGTC will be registered, shall ensure that conditions are fulfilled and that third country has approved Article 4(3a): according to equivalent conditions and procedures to those laid down in EGTC Regulation or in accordance with an agreement between at least one Member States and a third country

Regionalpolitik PRES compromise Additional legal basis taken out Article 3a: Several MSt + 3rd country: carry out territorial cooperation actions or implement programmes supported by the Union One MSt – 3rd country: cross-border or transnational cooperation or bilateral relations with 3rd country Article 4(3a): (in consultation with other Member States) in accordance with equivalent conditions and procedures to those laid down in EGTC Regulation or an agreement concluded between at least one Member States and a third country

Regionalpolitik PRES compromise equivalent conditions and procedures to those laid down in EGTC Regulation or Internal law/rules in the third country (a "national" EGTC Regulation; national implementing rules as in a MSt; ratification of (i.e. signing up to) the Madrid acquis, when allowing bodies to join legal bodies set up abroad an agreement concluded between at least one Member States and a third country Bilateral/trilateral agreements based on the Madrid acquis, when allowing bodies to join legal bodies set up under the law of a country being party to that agreement
