Long Term Care Ombudsman
What is Long Term Care (LTC)? Care for individuals provided by a nursing facility or an assisted living home What is an Ombudsman? Swedish word meaning representative of the people An official appointed to investigate individuals' complaints against maladministration Long term Care Ombudsman Paid employees or volunteers who resolve complaints on behalf of residents in long term care facilities with a priority for individuals 60 years and older Created by federal statute in 1978, one in every state In Alaska, we are in the Dept of Revenue under the Alaska Mental Health Trust Authority, so that we can investigate any agencies even the state How many people in the room are thinking of serving seniors in their ALH?

Duties of the LTC Ombudsman
VISIT EDUCATE EMPOWER RESOLVE I & R Visit: Quarterly unannounced visits to nursing and assisted living homes Educate: residents and family members about resident rights Empower: support residents to advocate for themselves Resolve: complaints by seniors living in nursing and assisted living homes. To residents satisfaction May investigate and resolve complaints by seniors not living in facilities related to their residential circumstances Complaints against senior housing manager, Financial exploitation I&R: assist seniors in locating to correct service/information to resolve their issue Systems Change: laws/regs and policies/practice Assisted living home regulations Implementation of the ADRD roadmap POA law API transition project SYSTEMS

OLTCO Process Who do we receive complaints from?
Resident/family/guardians Community members Care coordinators State licensing agencies-nursing facility and assisted living home Adult Protective Services (APS) Other providers including EMT, police, doctors, etc Facility administrators and staff What to we do when we receive a complaint? Generally visit day the complaint is received Talk with all the residents in the home Talk with guardians and family members May collect records Look for a solution that meets the residents expectations Talk with staff/administrator Make a referral if needed Follow up to ensure change continues 90 complaints a month, 90% come from ALH Confidentiality-cannot share with you who said what or who filed complaint but will work with you to resolve issue

Mandatory Reporter Alaska Statute requires suspected maltreatment of vulnerable be reported to Adult Protective Services by: Health care providers Clergy Law enforcement Guardians and conservators Administrators and employees of facilities Care coordinators Care givers Note: with the passage of SB 83 you no longer meet your reporting requirement by reporting to OLTCO! If the resident is over 60 years old, you can report to the LTCO and this meets the requirement under the MR law.

Unique Role of the LTCO LTC Ombudsman Nursing Home Licensing Residential Licensing Adult Protective Services Several agencies play a role in guarding the safety of seniors…. The LTC Ombudsman has a unique role: Jurisdiction Resolution Empowerment of residents Systems change Other agencies involved in guarding senior safety: Medicaid Fraud Control Unit Elder Fraud and Assistance Law Enforcement Court System Jurisdiction-from residents’ point of view Resolve Issues to residents’ satisfaction (may not be in resident’s best interest or what family would prefer) Empowerment-support residents to advocate for themselves, resident and family councils Systems change- statutes, regulations, policies, procedures administrative actions, public awareness of need for systems change Same vs Different LTC Ombudsman Adult Protective Services-send disposition reports to APS Nursing Home Licensing Assisted Living Home Licensing MFCU Elder Fraud and Assistance Law Enforcement Court System Also Occupational Licensing

Case related visits=191 Volunteers donated 360 hours Complaints 662 complaints 92% resolved to the satisfaction of the resident Contacts 399 consultations with individuals 153 consultations with facility staff 39 community education events
