Increased concern around exposure to waste workers, landfill operators, recycling center operators and general public
Heightened legislative and regulatory awareness and action
Who will pay??

3. LEGISLATION CURRENT LEGISLATION STILL ACTIVE: MA HB 3602 -
NJ SB 958 – Requires providing proper disposal information to patient
RI HB 7366 – Providing public proper disposal for used sharps
RI SB 2027 – Stewardship program for sharps disposal
REGULATIONS PASSED:
CA 486 – Requires Mfg of self injecting devices to have safe disposal plan and that the plan be posted
CO – State regulations for RMW were updated in 2011; provides additional guidance for home generated wastes
MN – Legislation passed requiring Mfg to have safe disposal plan by 7/2011
Other states have many guidance documents

4. LEGISLATION FAILED LEGISLATION:
CA SB 971 – Mfg of blood clotting products to provide proper sharps disposal
ME LD 1412 – Mfg participate in collection of sharps
ME LR 1325 – Proper disposal of sharps (no test)
NH HB 163 – Establish council to advise on proper disposal of home generated sharps
WA HB 1496 (SB 5632) – Mfg who sells drugs with self injectors or home use to establish collection programs

5. LEGISLATION
WHY DID LEGISLATION FAILED OR NOT GET STARTED IN OTHER STATES????
Resistance on the part of manufacturers to provide funding to set up programs
Insurance is not involved currently
Patients do not have money to cover cost of proper disposal or do not know their options
Disposal costs vary depending on program
Some programs offer just the container and then separate fee for shipping/disposal
No pick up program currently available
Not a priority in states where funding is major issue
Lack of legislative awareness
