3 Meat Only raw meats, beef, pork, lamb, fish and seafood, that are processed, packaged and labeled at an inspected facility or are otherwise exempt from inspection. Exempt meats: rabbit, quail and bison Poultry Meat products, other than fish and shellfish, must be brought to the market in frozen condition and kept frozen until sold. Fish and shellfish may be brought to the market at degrees Farenheit if this temperature is maintained.

4 Dairy Products All dairy products including, but not limited to milk, cheese and goat cheese, butter and yogurt must be processed, packaged and labeled at a facility permitted and inspected by the Alabama Department of Public Health’s Milk and Food Processing Branch. Sale of raw milk for human consumption is not legal and cannot be sold at farmers markets.

5 Honey & Boiled Peanuts Honey is considered an agricultural commodity and may be sold at farmers markets Products sold as ‘honey’ or using the word ‘honey’ must be pure honey. Boiled peanuts are considered an agricultural commodity and may be sold at farmers markets.

6 Home processed exemption Effective March 2009
Amended Chapter of the AL Dept of Public Health Administrative Code Excludes a kitchen in a private home from the definition of food establishment only for food that is non-potentially hazardous and is prepared for sale only at ‘State sanctioned’ farmers markets. Rule (7)(a)7(i) Is revised to effectively exclude Farmers Markets from regulatory requirements of the ADPH Home processed foods, with the exception of low acid foods, may be sold at Farmers Markets with appropriate labeling. Food sold under this exemption must be labeled with: This item(s) was prepared in a kitchen that is NOT inspected by a regulatory agency.

7 Cottage Food Law Effective June 2014 Cottage foods may be sold from home or at local farmers markets. Cottage food cannot be sold to: Restaurants Novelty shops Grocery Stores Over the internet

10 Persons operating food businesses under the Cottage Food Law must attend and pass a food safety course approved by the Alabama Department of Public Health. Persons selling non-potentially hazardous foods at state sanctioned farmers markets do not have to attend and pass a food safety course.
