Who is the real owner? It is common for companies to promote their products by having some sort of competition with large prizes. For example, a company might have a contest to see who can come up with the best slogan to promote a certain product. Another company might ask contestants to write approximately 50 words why they prefer a particular product.

Who is the real owner? Soft-drinks companies often have competitions that involves both big amount of money and other prizes. However, Pepsi, a leading soft-drink company, recently had a competition with a very rich prize. To participate in this contest, people had to purchase a bottle of Pepsi and look under a cap on the bottle. Customers could win prizes ranging from a free soft drink to one million dollars! Because of this contest, two workers in a health foods store recently had a problem regarding a Pepsi. Judy bought a Pepsi, which she left unopened in the refrigerator at work. Sindy, a coworker who worked the night shift, saw the Pepsi in the refrigerator and decided to drink it. After opening it, Sindy discovered that the bottle cap had the million-dollar prize.

Who is the real owner? Judy says that the Pepsi was hers and that the million-dollar prize should be hers. Sindy says that she founds the Pepsi in the refrigerator at work and that there is no way to prove that it is Judy’s drink. She said that she was cleaning the refrigerator and asked if the Pepsi belonged to anyone. Judy has no receipt for the drink. Former coworkers at the store testified that Judy was practically addicted to Pepsi and that the area where Judy left the soft drink, was the spot where she usually kept her bottles of Pepsi. Sindy offered to split the money with Judy, but she refused. The winner of this contest would not get a lump sum of one million dollars, but rather an annual payment of fifty thousand dollars for 20 years. The two women went to court when they could not resolve the issue amicably.

Discussion You are Sindy Allen. Your opinion is that the bottle cap is yours because you found it. You are Judy Richardson. You admit, and everyone you work with admits, that you are addicted to Pepsi. When you heard that Sindy had found the winning cap, you knew that is was a bottle of Pepsi that you had bought and put there earlier. You are Judy’s lawyer. You agree that your client left her drink in a public place. However, what if it had been her lunch bag? Would it have been OK for someone to open another person’s lunch bag and see what was inside? No, definitely not, so why is this situation any different? You are Sindy’s lawyer. You support your client’s position of “finders keepers, losers weepers”. You believe that when someone leaves something, there is a general belief that he or she doesn’t want that thing any longer. #1 #2 #3 #4
