PURPOSE To provide responses and government plans on the petitions sent to the Portfolio Committee on Human Settlements from various communities in Ekurhuleni and the City of Johannesburg Metropolitan Municipalities

CONTENTS Petition from residents of Friendship Town calling for an investigation into sale of Komati, Lethabong and Indlovu Flats to private companies (Mr M Waters); Petition from residents of Meadowland Hostel, Zone 11, Soweto, calling for assistance in acquiring social housing and improved service delivery (Mr T W Mhlongo); Petition from backyard dwellers of Phomolong Wards 12 and 13, Ekurhuleni Metropolitan Municipality; (Mr M Waters MP) Petition from residents of Struisbult, Ekurhuleni Metropolitan Municipality, Gauteng, calling for the eradication of their informal settlements and improved service delivery in respect of housing (Mr M Waters MP);

RESPONSES TO PETITIONS AND ANNEXURES GOVERNMENT PLANS OF ACTION(ALL SPHERES) DELIVERY DATE IMPLEMENTING SPHERES OF GOVERNMENT 1. Petition on the sale of Komati, Lethabong known as Commercia x9 –Friendship and Ndlovhu Flats - Commercia Extension 9 was as a result of a joint venture between the disestablished Lethabong Municipality and the Peoples Republic of China. - An MOU was signed between the two governments. - In terms of the said Agreement entered into, the Lethabong Municipality made land available to the Peoples Republic of China for the development of affordable Institutional housing. - These properties are not RDP houses but bonded houses and institutional housing units financed by the Financial Institutions. - The Gauteng Human Settlements Department funded the rental part of the development through the Institutional Housing Subsidy. Continues on the next slide - It is recommended that the Gauteng Human Settlements be joined as a critical role player in resolving the dispute, in line with the Public Protector’s Conciliation outcome in November 2016. - That an occupant’s survey be undertaken to determine the personal circumstances of affected occupants. - That an alternative project be identified to address the specific categories of occupants who are need accommodation. - That The Public Protector’s dispute resolution measures be allowed to ensue with the participation of all key role-players. - The EMM is searching for the Council resolution taken for the alienation of the land by the Lethabong Housing Institution. - The aforementioned resolution will be presented during the hearing once found. RESPONSES TO PETITIONS AND ANNEXURES GOVERNMENT PLANS OF ACTION(ALL SPHERES) DELIVERY DATE IMPLEMENTING SPHERES OF GOVERNMENT Petition on the sale of Komati, Lethabong known as Commercia x9 –Friendship and Ndlovhu Flats continues ….. During the investigation it was established that tenants benefited from institutional housing subsidies. It was established that this scheme was communicated to tenants as the rent to buy after which tenants would be entitled to buy the rented units. The units were sold to some tenants, whilst some did not get the opportunity to benefit. The remaining tenants had to continue renting the rental units. It is this group of tenants who feel aggrieved as some could no longer afford keeping payment of rentals. It must be mentioned that the lease agreements concluded between the tenants and the Lethabong Housing Institution (and subsequent owners) provided for the cession or rights by the landlord, in terms of which the lessor could transfer rights. It transpired that some tenants defaulted on rentals and were evicted sometime in The Gauteng Human Settlements Department became involved in intervening and made certain proposals, as redress but did not action its proposal. Petition on Meadowlands Hostel Zone 11 City of JHB Lack of Housing and Waiting List 96/97 2.2 Lack of Collection of Rubbish Bins 2.3 No Water Drainage - City wide database for 96/97 was compiled during 2015/2016 financial year -Pick it Up collects refuse on a weekly basis at designated collection points - There is existing water and sewer infrastructure in the hostel - This demand data base will be used for all our Greenfield and Brown Field Project and is being in-fused with the National Demand Database - To facilitate beneficiary education and make sure the collections times are well publicised - As part of the Hostel upgrade programme between the City’s and Provincial Government to provide adequate basic level of service .We have embarked on Hostel Upgrade Programme implementing the CRU Programme. - On-going 2017/2018 to 2021 City of Joburg PETITIONS RESPONSES TO PETITIONS AND ANNEXURES GOVERNMENT PLANS OF ACTION(ALL SPHERES) DELIVERY DATE IMPLEMENTING SPHERES OF GOVERNMENT

First outfall sewer line was upgraded during the 2015/2016 financial year. Second portions planned for the 2017/2018 Upgrade of the Bulk sewer lines, as well as Internal water and sewer reticulation - On-going - City of Joburg

Petition from backyard dwellers of Phomolong Wards 12 and 13, EMM. - Calling for assistance in acquiring social housing (Mr M Waters MP Community Consultation: The EMM Human Settlements Oversight Committee held a meeting with the Phomolong Backyard Tenants Forum on 14 August The resolutions is attached as Annexure B. A public meeting led by the Chairperson of the Human Settlements Oversight committee was held with the community of Phomolong, to inform the later that a service provider would be appointed to conduct occupancy survey. The service provider was introduced to the Phomolong community prior to commencement of the survey A public meeting was convened on the 2nd and the 3rd of October 2015 led by the MMC: Human Settlements to present the findings of the survey to the Phomolong Tenants Forum committee and to the broader members of the community The survey findings concluded that majority of the backyard tenants in Phomolong have no direct access to basic services such as water and sanitation and that the majority was interested in rent to buy housing option. Provision of Rental Housing Opportunities To qualifying Phomolong backyard dwellers in the following projects 1. Proposed Birchleigh North Extension 4 which is a mixed income and various housing typologies (Approval of township application has been delayed because of objections received from the adjacent land owners) 1440 rental housing opportunities - Project will be constructed in phases. - Internal services installation will commence in 2018/19 (subject to township approval) and completed by 2021/22 - Installation of Bulk Services will be completed by 2020/21 - Housing top structure construction to commence 2020/21 Ekurhuleni Metropolitan Municipality 2. Clayville X 45 Phase One: 1 420 rental housing opportunities Internal services (excluding electricity) is completed Top structure construction will commence in 2018/19 FY Gauteng Department of Human Settlements

Petition from residents of Daggafontein / Struisbult , Ekurhuleni Metropolitan Municipality ( EMM) - The Human Settlements Portfolio Committee to investigate why the informal settlements of Struisbult , Ekurhuleni has not received decent housing for all despite a promise that this would be done by 2014 - Calling for the eradication of the informal settlements and improved service delivery in respect of housing (Mr M Waters MP) 1. The Daggafontien Informal settlement is situated on the remainder of farm 113/125 IR Modderfontein along Vogen Strubben road in Springs. 2. This informal settlement consists of approximately 1649 households. 3. The land portions are partly owned by EMM and private companies (Afrisam and Modderfontein Mines Ltd). The EMM GIS Data sets currently highlight that there is a probability of medium risk dolomite. 4. Furthermore there is a slimes dam next to the developments which may have issues like Radon Gas emissions and from other projects a 500M Buffer zone will be applicable and imposed by GDARD. 1. With these issues, it is not feasible to upgrade the settlement in situ and the decision was made now to relocated the community to Brakpan Old Location Ext 13 Mega project that has a total yield of 7488 housing opportunities (2326 Res 2 & 5162 Res4). (see Annexure A) -This project is planned for relocation to the Brakpan old Location Mega project as they cannot be accommodated in situ due to environmental issues. 2. An alternative site was also identified but was not pursued due to unavailability of the site. This information was relayed by the MMC in Mid 2016 3. Another alternative plan for this settlement is currently being driven by the Province and they are currently negotiating with a private land owner to purchase housing opportunities in Edelweiss extension 03, which is in close proximity to the settlement. The township consists of over housing opportunities and the Municipality has agreed that we would provide services as per municipal mandate should the deal be finalised. 1. Designs & Installations of all engineering services EMM-HS making proposal for funding of servicing of all Mega Projects in the next FY 2. USDG budget in 2018/19 for installation. 2017/18 and 2018/19 FY 3. Top Structure Construction EMM-HS engaging the Gauteng Department of Human Settlements Project to find expression in the 2018/19 APP 2019/20 FY Ekurhuleni Metropolitan Municipality and Provincial Dept of Human Settlements for funding

RESPONSES TO PETITIONS AND ANNEXURES GOVERNMENT PLANS OF ACTION(ALL SPHERES) DELIVERY DATE IMPLEMENTING SPHERES OF GOVERNMENT Petition from residents of Soweto (Orlando, Diepkloof, Meadowlands, Dube and Mzimhlope) 5.1 Department to give status Update on when will 96/97 beneficiarise receive RDP The department through an approved Council resolution embarked on a 96/97 beneficiaruy registration programme. Which was completed in the 2015/2016 financial year The registartion has been completed and infused with the National Demand Database on housing. This information is awaiting the Executive Mayors approval for roll out in partnership with Provincial and National Government. - Process started in prioritising the 96/97 in our current project(Greenfields and Brown fields) City of Joburg 5.2 Department to commit to publishing the waiting list on public platform The information on 96/97 beneficiaries has been documented and waiting to be rolled in line with the National Demand Database programme As per the National Human Settlement pronouncement the National Database will be made available once the system is ready Work in Progress All spheres of Government

Villa Liza Housing Project (Ward 99) - Mismanagement on allocation of houses - Allegations that foreigners & people outside the area are occupying houses - Allegations that CLO benefitted more than one house The same issues were discussed in a conciliation meeting of the Public Protector that took place on 8 November The petitioners were also present during this meeting where these allegations were discussed and it was resolved that the matter will be finalized by the Office of the Public Protector. The same petition was also registered with the Office of the Public Protector and the Chairperson of the National Portfolio Committee on Human Settlements Annexure A: Response to petition to Office of the Public Protector with reference number 7/ /14 dated 25 October (Complete with attachments A-C) Annexure A1: Response to the Chairperson of the National Portfolio Committee on Human Settlements dated 10 February 2017 - The Leeuwpoort Development has been identified to accommodate the overflow of the households. - Construction will be done over a seven (7) year period, and completed in 2023/24 - Various studies have been done - residential market studies were commissioned in January 2016, to focus on residential market for bonded and FLISP housing. - Informal Settlements Residents in the Boksburg area including those in the waiting list, will benefit from the project Construction will be done over a seven (7) year period, and completed in 2023/24 Gauteng Department Human Settlements and Ekurhuleni Human Settlements
