All cutting or clearing of trees is prohibited therein except as deemed a danger to residential improvements or as diseased. Contingency fund ($5K savings acct) not touched. Dues increased from $380 to $400 for First increase in 3 years. Funds saved from prior years allowed extra money to be spent on Front Entrance revitilization and tree removal. We need to decide how to fund sprinkler replacement. Special Assessment or higher dues?

Owners Easements of Enjoyment. b) the right of the Association to suspend the voting rights and right to use of the recreational facilities by an owner for any period during which any assessment against his Lot remains unpaid; and for a period not to exceed 60 days for any infraction of its published rules and regulations Article VII General Provisions Section 1. Enforcement. Architectural Control Committee Oversee and approve architectural and exterior changes Items Covered Building, Fence, Wall, Driveway, Roof, Antenna Conduct annual review of houses for covenant compliance and general appearance Maintenance Committee Organize and set up work parties for neighborhood projects Oversee maintenance of common areas Oversee landscape revitalization projects Social Committee Organize and set up neighborhood social events Deliver welcome baskets to new residents “Section 8” term refers to the portion of the Housing Act of 1937 and is a HUD subsidized housing voucher program to provide assistance to low income individuals and families. Tenant pays up to 30% of income for rent, and gov’t pays remainder to landlord at Fair Market Rate. Benefits to landlord: a large available pool of potential renters (the waiting list for new Section 8 tenants is usually very long, see below), generally prompt regular payments from the PHA for its share of the rent, and/or a perceived higher quality of tenants, since a tenant can be permanently removed from the Section 8 program if s/he damages the rental unit and/or fails to pay his/her share of the rent. Families who participate in the program must abide by a series of rules and regulations, often referred to as "family obligations," in order to maintain their voucher.

27 Rules & Regulations FFHA currently has no effective mechanism for enforcing our covenants. Other nearby HOAs have adopted R&Rs: Fairwood Greens Candlewood Ridge Carriage Wood FFHA Board is proposing the adoption of R&Rs in 2017 to cover: Recreational Vehicles Vehicles (ones that rarely move) Architectural Control (roofs, fences, paint colors) Landlord Responsibilities In Home Businesses Appeal Process

28 Rules & Regulations A committee has worked throughout 2016 developing the R&Rs and preparing the documents. Fairwood Greens HOA is allowing us to use their R&Rs as a template. When violations of covenants occur, the R&Rs generally require a warning letter be sent before the imposition of monetary fines. Certain ongoing violations of a permanent nature will be grandfathered in – roofs, driveways, fences.

29 Rules & Regulations Our attorney has been consulted, and we have the green light to proceed. Adoption of R&Rs requires a majority vote of the FFHA Board. The Board will be responsible for enforcement. An Appeal Process will be adopted. It’s critical that there is strong support from the community for adopting R&Rs.
