Assessment – rigid approach allowing no flexibility, only concerned with personal care and eating and drinking Charging for social care – charging more than can be afforded, disability related expenditure not taken into account Use of pre-payment cards

Employing PAs – actively discouraging having direct payments and employing PAs, no information on being a good employer Hourly rate for direct payment holders – rarely reviewed, does not cover all costs Integration – endless arguments between Las and CCGs

6 UNCRPD United Nations convention on the Rights of People with Disabilities Formal examination of UK implementation takes place in 2017 Article 10 Right to Life Article 14 Liberty and Security of the Person – Disabled People are not deprived of their liberty simply because they are Disabled People Article 19 Living Independently and being Included in the Community Article 25 Health - The Right to enjoy the best possible health, and to have the same access to health care services as everyone else

7 Issues to be Raised 1 Amongst mental health service users. A sharp rise in the number of unexpected deaths No independent system for investigating the deaths of people with learning disabilities Mental Health Act 1983 and Mental Capacity Act 2005 not compliant with the UNCRPD

8 Issues to be raised 2 Rapid rise in the number of compulsory community and detention orders No right to independent living in English law only ‘wellbeing’ Care packages inadequate to enable inclusion in the community Restriction on Choice Some CCGs have policies making residential care compulsory for people with high support needs

9 Issues to be raised 3 Premature deaths of people with learning disabilities 75% of people with mental health issues do not receive treatment compared with 25% of physical health issues Disabled people have difficulties accessing routine health screening programmes

10 CRPD Process Report submitted to UN committee
Committee receives other reports including from government Committee decides on its issues of concern UK response Conclusion and recommendations
