Objective of standardisation
Overall objective: ~ (EC) No 216/2008 Standardisation objective: ~ (EU) No 628/2013 Establish and maintain a high uniform level of civil aviation safety in Europe. Monitor the application by the Competent Authorities of the applicable requirements as well as their uniform implementation. 12 May 2017 ADR.AT

Verification of compliance at CA / UT
Verification of Authority activities Undertakings are visited as samples to evaluate CA’s oversight. No findings, can be raised by EASA against undertakings, but all the undertakings’ non-compliances (UNC) detected shall be recorded and monitored by EASA. They can either: provide supporting evidence and/or be the consequence of a non- compliance of the CA (Type 1) not be directly correlated to a deficiency by the CA (Type 2) UT 1 C A UT 2 UT 3 Dealing with UNCs: UNCs (type 1) provide supporting evidence and/or are the consequence of a non-compliance of the CA with the applicable requirements. Managed by EASA and closed based on evidence submitted by CA. UNCs (type 2) cannot be directly correlated to a deficiency at the CA level, as it does not provide any evidence of a failure in the way the CA has discharged its oversight responsibilities. The STL in charge should do his utmost to reduce the agreement time as much as possible. It is then important that the STL communicates to the Competent Authority the EASA agreement on corrections and corrective actions for class D findings in the shortest possible timeframe after they are processed. This shall be done by with a status report extracted from the database as attachment. In the cases referred to in paragraph 1, the Agency shall request the competent authority to provide clarifications on the failure and to submit supplementary actions, setting a time-limit for the response. The Agency shall assess the consequence of the failure together with the response provided by the competent authority within the set time-limit. Based on the outcome of such assessment, the Agency may: agree with the supplementary actions submitted; or issue a supplementary report to the competent authority concerned and to the Commission. That report shall include the Agency's assessment and recommendations to the Commission, including when deemed necessary recommendations on the mutual recognition of certificate(s) issued by the competent authority. Without prejudice to Regulation (EC) No 2111/2005, following receipt of the supplementary report referred to in paragraph 3(b), the Commission may take any of the following steps: address comments to the Member State concerned or request further explanation to clarify all or part of the findings of non-conformity; require the Agency to carry out an ad-hoc inspection to check the satisfactory implementation of corrections and corrective actions; initiate the procedure referred to in Article 11(2) of Regulation (EC) No 216/2008 to decide whether certificates issued by the competent authority comply with the applicable requirements; initArticle 22 The Agency shall identify any failure to follow up a finding of non-conformity such as: corrective action not submitted within the period referred to in Article 17(1); corrective action not agreed by the Agency within the period referred to in Article 17(4)(b); In the cases referred to in paragraph 1, the Agency shall request the competent authority to provide clarifications on the failure and to submit supplementary actions, setting a time-limit for the response.
